b. As respects Workers' Compensation insurance in the state of Washington, <br /> Contractor shall secure its liability for industrial injury to its employees in <br /> accordance with the provisions of RCW Title 51. <br /> c. If Contractor is qualified as a self-insurer in accordance with RCW 51.14, <br /> Contractor shall so certify by letter signed by a corporate officer indicating that it <br /> is a qualified self-insured and setting forth the limits of any policy of excess <br /> insurance covering its employees. <br /> 10. Self-Insurance <br /> a. At its sole option and in its sole discretion, Owner may accept Contractor's self- <br /> insurance for a liability coverage in lieu of insurance from an insurer. <br /> b. Contractor must provide a letter from its Corporate Risk Manager, or appropriate <br /> Finance Officer representing and warranting the following minimum information: <br /> whether the self-insurance program is actuarially funded; the fund limits; any <br /> excess declaration pages to meet the Contract requirements; a description of how <br /> Contractor would protect and defend the Owner as an Additional Insured in their <br /> Self-Insured layer; and claims-handling directions in the event of a claim. <br /> c. Any amounts due to, sought by, or paid to third party claimants shall be the sole <br /> responsibility of the Contractor, irrespective of whether such amount falls wholly <br /> within the level or amount of the Contractor's self-insured retention. <br /> ARTICLE 16 LAWS, REGULATIONS AND PERMITS <br /> 16.1 General <br /> A. The Contractor shall give the Notices required by law and comply with all laws, ordinances, <br /> rules and regulations pertaining to the conduct of the Work. <br /> B. The Contractor shall indemnify, defend, and save harmless the City (including its agents, <br /> officers, and employees) against any claims that may arise because the Contractor (or any <br /> employee of the Contractor or Subcontractor or material person) violated a legal <br /> requirement. <br /> C. The Contractor shall be liable for violations of same in connection with Work provided by <br /> the Contractor; and Contractor shall cooperate with all governmental entities regarding <br /> inspection of the Work and compliance with such requirements. <br /> D. If the Contractor observes that the Drawings, Specifications or other portions of the <br /> Contract Documents are at variance with any laws, ordinances, rules or regulations, he or <br /> she shall promptly notify the Owner's Representative in writing of such variance. <br /> E. The Owner will promptly review the matter and, if necessary, take appropriate action. <br /> F. Contractor agrees not to perform Work it knows, or in the exercise of ordinary care should <br /> know, to be contrary to any laws, ordinances, rules or regulations. <br /> G.
