I <br /> CITY OF EVERETT SPECIAL PROVISIONS I <br /> 1-07 LEGAL RELATIONS AND RESPONSIBILITIES TO THE PUBLIC <br /> 1-07.1 Laws to be Observed 1 <br /> Revise 1-07.1 by replacing the second sentence of the first paragraph with the following: <br /> The Contractor shall indemnify, defend, and save harmless the City (including its agents, <br /> officers, and employees) against any claims that may arise because the Contractor (or <br /> any employee of the Contractor or Subcontractor or material person) violated a legal <br /> requirement. <br /> Supplement 1-07.1 by adding the following: <br /> The Contractor shall be in compliance at all times with all COVID-19 Requirements <br /> applicable to the Work. <br /> Contractor's Bid includes all costs necessary for the duration of the Work for compliance <br /> with Baseline COVID-19 Requirements. All such costs are included in the lump sum bid <br /> item entitled "Baseline COVID-19 Requirements." <br /> If the COVID-19 Requirements applicable to the Work at any time after Bid opening <br /> become less stringent than the Baseline COVID-19 Requirements, the Contractor may <br /> implement the less-stringent COVID-19 Requirements instead of the Baseline COVID-19 <br /> Requirements, but the City will be entitled to a deductive change order as described in <br /> Section 1-09.4(3) COVID-19 EQUITABLE ADJUSTMENTS. <br /> Supplement 1-07.1 by adding the following: <br /> The Contractor shall be in compliance with all applicable standards, orders, or I <br /> requirements issued under Section 306 of the Clean Air Act [42 U.S.C. 1857(h)], Section <br /> 508 of the Clean Water Act (33 U.S.C. 1368), Executive Order 11738, and Environmental <br /> Protection Agency Regulations (40 CFR Part 15). (Contracts, subcontracts, and subgrants <br /> of amounts in excess of$100,000). <br /> The Contractor shall comply with mandatory standards and policies relating to energy <br /> efficiency that are contained in the state energy conservation plan issued in compliance <br /> with the Energy Policy and Conservation Act (Pub. L. 94-163). <br /> The City advises all general contractors and subcontractors that numerous Federal, State, <br /> and Local regulations exist that could affect the procedures used in the completion of this <br /> project. The City advises each prospective Contractor that they are responsible to be <br /> aware of and comply with all applicable statutes and regulations. It is recommended that <br /> each Contractor contact the local office of the following agencies for a list of applicable <br /> regulations and requirements that might affect the implementation of this project: <br /> • Federal Environmental Protection Agency <br /> • Washington Department of Health 111 <br /> • Washington Department of Ecology <br /> • Washington Department of Fisheries <br /> • Washington Department of Wildlife <br /> • Washington Department of Labor& Industries I <br /> • Puget Sound Air Pollution Control Agency <br /> • Municipal Building Department <br /> • Municipal Planning Department <br /> • Municipal Public Works Department <br /> If the scope of Work in this Contract includes Work at the City of Everett Water Filtration <br /> Plant or the Waste Water Pollution Control Facility, Contractor shall comply with the <br /> requirements of the Washington Department of Labor& Industries for such work including, <br /> but not limited to, Chapter 296-67 WAC.
