DocuSign Envelope ID:C5A1041B-30CD-42D2-B9F2-796D621B08B1 <br /> LICENSE TO USE CITY PROPERTY <br /> THIS LICENSE AGREEMENT (the "License"), between the City of Everett, a <br /> municipal corporation, as Grantor (the "City) and Snohomish County Public <br /> Transportation Benefit Area aka Community Transit, a municipal corporation, as the <br /> Grantee ("Community Transit"), relates to the city owned parking lot located at the <br /> northeast corner of 26th Street and W. Marine View Drive, Everett, WA (the"Property"). <br /> RECITALS <br /> A. Community Transit desires to utilize the property for parking of <br /> Community Transit fleet vehicles. <br /> B. The City is willing to grant Community Transit authority to use the <br /> City's property upon certain terms and conditions. <br /> AGREEMENT <br /> In consideration of good and valuable consideration, the receipt and sufficiency of which <br /> is hereby expressly acknowledged, the City licenses Community Transit to use the <br /> Property upon the following terms and conditions: <br /> Section 1. LICENSED PROPERTY. The specific area of property owned by the <br /> City, and subject to this License, is legally described as LOTS 5 THRU 16, BLOCK 558, <br /> PLAT OF EVERETT DIV. G, as filed for record under Vol. 4, Page 41, records of <br /> Snohomish County, State of Washington. <br /> Section 2. TERM. This License shall be effective beginning at 6:00 A.M. June 1, <br /> 2021 and shall expire at midnight on May 31, 2022, unless terminated earlier per Section <br /> 7, below. Any tenancy after the initial term shall be on a month to month basis. <br /> Section 3. MONTHLY CONSIDERATION. Community Transit shall pay <br /> $3,220 per month, due on the first day of each month during the term of this License. <br /> Section 4. AUTHORIZED USE. Community Transit may only use the property <br /> for the purpose of parking of fleet vehicles. <br /> Section 5. INDEMNIFICATION. Community Transit hereby agrees to defend, <br /> indemnify and hold the City harmless from any and all Claims for injury to people or <br /> damage to property to the extent arising out of or relating to Community Transit's use of <br /> the Licensed Property. This defense and indemnification obligation shall survive any <br /> termination, revocation or expiration of this Agreement. For the purpose of this Section <br /> 4, the following terms shall have their specified meaning. "City" means the City, its <br /> page 1 <br />
