This License is personal to Community Transit <br /> and may not be transferred, assigned, conveyed,pledged, encumbered, or hypothecated. <br /> Section 10. COMPLIANCE WITH LAW. Community Transit agrees to comply <br /> with all applicable Federal, State, and Local laws and regulations and to acquire all <br /> permits required by law or regulation. <br /> Section 11. INSURANCE. Community Transit shall maintain commercial general <br /> liability insurance coverage during the term of this License with $1,000,000 combined <br /> single limits, which insurance shall be primary and non-contributing. Community <br /> Transit shall ensure the City is endorsed as an additional insured on the policy. <br /> Community Transit shall provide the City evidence of coverage and endorsement. <br /> Insurance coverage and limits of liability as specified herein are minimum coverage and <br /> limit of liability requirements only. They shall not be construed to limit the liability of <br /> Community Transit -or any insurer for any claim that is required to be covered <br /> hereunder. Moreover, the City shall be an additional insured, where additional insured <br /> status is required, for the full available limits of liability maintained by Community <br /> Transit,whether those limits are primary, excess, contingent or otherwise. <br /> Section 12. NON-INTERFERENCE WITH CITY USE. Community Transit use <br /> of the property shall not interfere in any way with any City use of the property, including <br /> utilities and travel. <br /> Section 13. REPAIR OF PROPERTY. Community Transit shall use care to avoid <br /> damaging or destroying City property by reason of its use pursuant to this License. Any <br /> damage caused by Community Transit to City or other property shall be promptly <br /> repaired or replaced by Community Transit to the satisfaction of the City, or in lieu of <br /> such repair or replacement, Community Transit shall pay, to the City or owner of the <br /> other property, money in an amount sufficient to compensate for the loss sustained by <br /> reason of damage to or destruction of the City's or other party's property. <br /> Section 14. RISK OF LOSS TO GRANTEE'S PROPERTY. Community Transit <br /> bears all risk of any and all damage and loss to personal property located on the property <br /> associated with this License and Community Transit's use of the Property. <br /> Section 15. NO WARRANTY. The City does not warrant its title or ownership of the <br /> Property. <br /> Section 16. NON-EXCLUSIVE. This License is not exclusive. The City is not <br /> prohibited from granting permission to others to occupy or use portions of the property <br /> where such uses are not inconsistent with this License. <br /> Section 17. RESERVATION OF RIGHTS. The City reserves all rights not <br /> expressly granted by this License. <br /> page 3 <br />
