I 1 1-05.15.RTF I 2 1-05.15 Method of Serving Notices 3 (March 25, 2009 APWA GSP) I 4 Revise the second paragraph to read: 5 6 All correspondence from the Contractor shall be directed to the Project Engineer. All I 7 correspondence from the Contractor constituting any notification, notice of protest, notice 8 of dispute, or other correspondence constituting notification required to be furnished 9 under the Contract, must be in paper format, hand delivered or sent via mail delivery I 10 11 service to the Project Engineer's office. Electronic copies such as e-mails or electronically delivered copies of correspondence will not constitute such notice and will 12 not comply with the requirements of the Contract. 13 I14 1-05.16.RTF 15 Add the following new section: 16 I 17 1-05.16 Water and Power 18 (October 1, 2005 APWA GSP) 19 I 20 21 The Contractor shall make necessary arrangements, and shall bear the costs for power and water necessary for the performance of the work, unless the contract includes power 22 and water as a pay item. I 23 24 1-07.GR1 25 Legal Relations and Responsibilities to the Public I 26 27 1-07.1.RTF 28 1-07.1 Laws to be Observed I 29 (October 1, 2005 APWA GSP) 30 31 Supplement this section with the following: 32 I 33 In cases of conflict between different safety regulations, the more stringent regulation 34 shall apply. 35 I 36 The Washington State Department of Labor and Industries shall be the sole and 37 paramount administrative agency responsible for the administration of the provisions of 38 the Washington Industrial Safety and Health Act of 1973 (WISHA). I 39 40 The Contractor shall maintain at the project site office, or other well known place at the 41 project site, all articles necessary for providing first aid to the injured. The Contractor I 42 43 shall establish, publish, and make known to all employees, procedures for ensuring immediate removal to a hospital, or doctor's care, persons, including employees, who 44 may have been injured on the project site. Employees should not be permitted to work I45 on the project site before the Contractor has established and made known procedures 46 for removal of injured persons to a hospital or a doctor's care. 47 48 The Contractor shall have sole responsibility for the safety, efficiency, and adequacy of II 49 the Contractor's plant, appliances, and methods, and for any damage or injury resulting 50 from their failure, or improper maintenance, use, or operation. The Contractor shall be 51 solely and completely responsible for the conditions of the project site, including safety I52 for all persons and property in the performance of the work.
