I <br /> 1 1 08.4RTF <br /> 2 1-08.4 Prosecution of Work <br /> 3 <br /> I 4 Delete this section and replace it with the following: <br /> 5 <br /> 6 1-08.4 Notice to Proceed and Prosecution of Work <br /> 7 (July 23, 2015 APWA GSP) <br /> I8 <br /> 9 Notice to Proceed will be given after the contract has been executed and the contract <br /> 10 bond and evidence of insurance have been approved and filed by the Contracting <br /> I 11 Agency. The Contractor shall not commence with the work until the Notice to Proceed <br /> 12 has been given by the Engineer. The Contractor shall commence construction activities <br /> 13 on the project site within ten days of the Notice to Proceed Date, unless otherwise <br /> I 14 approved in writing. The Contractor shall diligently pursue the work to the physical <br /> 15 completion date within the time specified in the contract. Voluntary shutdown or slowing <br /> 16 of operations by the Contractor shall not relieve the Contractor of the responsibility to <br /> I 17 complete the work within the time(s) specified in the contract. <br /> 18 <br /> 19 When shown in the Plans, the first order of work shall be the installation of high visibility <br /> I 20 fencing to delineate all areas for protection or restoration, as described in the Contract. <br /> 21 Installation of high visibility fencing adjacent to the roadway shall occur after the <br /> 22 placement of all necessary signs and traffic control devices in accordance with 1-10.1(2). <br /> 23 Upon construction of the fencing, the Contractor shall request the Engineer to inspect the <br /> I24 fence. No other work shall be performed on the site until the Contracting Agency has <br /> 25 accepted the installation of high visibility fencing, as described in the Contract. <br /> 26 <br /> 27 1-08.5.0ptionA.RTF <br /> 28 1-08.5 Time for Completion <br /> 29 (November 30, 2018 APWA GSP, Option A) <br /> I 30 <br /> 31 Revise the third and fourth paragraphs to read: <br /> 32 <br /> I 33 Contract time shall begin on the first working day following the Notice to Proceed Date. <br /> 34 <br /> 35 Each working day shall be charged to the contract as it occurs, until the contract work is <br /> I 36 physically complete. If substantial completion has been granted and all the authorized <br /> 37 working days have been used, charging of working days will cease. Each week the <br /> 38 Engineer will provide the Contractor a statement that shows the number of working days: <br /> 39 (1) charged to the contract the week before; (2) specified for the physical completion of <br /> I40 the contract; and (3) remaining for the physical completion of the contract. The <br /> 41 statement will also show the nonworking days and any partial or whole day the Engineer <br /> 42 declares as unworkable. Within 10 calendar days after the date of each statement, the <br /> 43 Contractor shall file a written protest of any alleged discrepancies in it. To be considered <br /> 44 by the Engineer, the protest shall be in sufficient detail to enable the Engineer to <br /> 45 ascertain the basis and amount of time disputed. By not filing such detailed protest in <br /> 46 that period, the Contractor shall be deemed as having accepted the statement as <br /> 47 correct.
