I 1 1 08.4RTF 2 1-08.4 Prosecution of Work 3 I 4 Delete this section and replace it with the following: 5 6 1-08.4 Notice to Proceed and Prosecution of Work 7 (July 23, 2015 APWA GSP) I8 9 Notice to Proceed will be given after the contract has been executed and the contract 10 bond and evidence of insurance have been approved and filed by the Contracting I 11 Agency. The Contractor shall not commence with the work until the Notice to Proceed 12 has been given by the Engineer. The Contractor shall commence construction activities 13 on the project site within ten days of the Notice to Proceed Date, unless otherwise I 14 approved in writing. The Contractor shall diligently pursue the work to the physical 15 completion date within the time specified in the contract. Voluntary shutdown or slowing 16 of operations by the Contractor shall not relieve the Contractor of the responsibility to I 17 complete the work within the time(s) specified in the contract. 18 19 When shown in the Plans, the first order of work shall be the installation of high visibility I 20 fencing to delineate all areas for protection or restoration, as described in the Contract. 21 Installation of high visibility fencing adjacent to the roadway shall occur after the 22 placement of all necessary signs and traffic control devices in accordance with 1-10.1(2). 23 Upon construction of the fencing, the Contractor shall request the Engineer to inspect the I24 fence. No other work shall be performed on the site until the Contracting Agency has 25 accepted the installation of high visibility fencing, as described in the Contract. 26 27 1-08.5.0ptionA.RTF 28 1-08.5 Time for Completion 29 (November 30, 2018 APWA GSP, Option A) I 30 31 Revise the third and fourth paragraphs to read: 32 I 33 Contract time shall begin on the first working day following the Notice to Proceed Date. 34 35 Each working day shall be charged to the contract as it occurs, until the contract work is I 36 physically complete. If substantial completion has been granted and all the authorized 37 working days have been used, charging of working days will cease. Each week the 38 Engineer will provide the Contractor a statement that shows the number of working days: 39 (1) charged to the contract the week before; (2) specified for the physical completion of I40 the contract; and (3) remaining for the physical completion of the contract. The 41 statement will also show the nonworking days and any partial or whole day the Engineer 42 declares as unworkable. Within 10 calendar days after the date of each statement, the 43 Contractor shall file a written protest of any alleged discrepancies in it. To be considered 44 by the Engineer, the protest shall be in sufficient detail to enable the Engineer to 45 ascertain the basis and amount of time disputed. By not filing such detailed protest in 46 that period, the Contractor shall be deemed as having accepted the statement as 47 correct. If the Contractor is approved to work 10 hours a day and 4 days a week (a 4-10 48 schedule) and the fifth day of the week in which a 4-10 shift is worked would ordinarily be I 49 50 charged as a working day then the fifth day of that week will be charged as a working day whether or not the Contractor works on that day.
