Act, chapter 42.56 RCW (the "Act"). <br /> XIV. COMPLIANCE WITH FUNDING SOURCE REQUIREMENTS <br /> The Agency shall comply with all conditions, terms and requirements of any funding <br /> source that wholly or partially funds the Agency's work under any Contract. <br /> XV, PROPRIETARY SOFTWARE APPLICATIONS <br /> In the event the Agency accesses the Snohomish County's or the City's proprietary <br /> software applications to perform any work under any Contract, the Agency shall read <br /> and agree to the terms and conditions of the software license agreement, and shall not <br /> violate the terms and conditions of the software license agreement including, but not <br /> limited to: <br /> A. Restricting the use of the software application to employees or subcontractors; <br /> B. Not"pirating" or reverse engineering the software application; and/or <br /> C. Otherwise using the application in any way that may harm Snohomish County or <br /> City or violate the terms and conditions of the software license agreement. <br /> XVI. COMPLIANCE WITH SNOHOMISH CITY HUMAN RIGHTS ORDINANCE <br /> It is the policy of Snohomish County to reject discrimination which denies equal <br /> treatment to any individual because of his or her race, creed, color, national origin, <br /> families with children, sex, marital status, sexual orientation, age, honorably discharged <br /> veteran or military status, or the presence of any sensory, mental, or physical disability or <br /> the use of a traineddog guide or service animal by a person with a disability as provided in <br /> Washington's Law against Discrimination, Chapter 49.60 RCW, and the Snohomish <br /> County Human Rights Ordinance, Chapter 2.460 SCC. These laws protect against <br /> specific forms of discrimination in employment, credit transactions, public <br /> accommodation, housing, Snohomish County facilities and services, and Snohomish <br /> County contracts. <br /> The Agency shall comply with the substantive requirements of Chapter 2.460 SCC, which <br /> are incorporated herein by this reference. Execution of a Contract constitutes a <br /> certification by the Agency of the Agency's compliance with the requirements of Chapter <br /> 2.460 SCC. If the Agency is found to have violated this provision, or to have furnished <br /> false or misleading information in an investigation or proceeding conducted pursuant to <br /> this Agreement or Chapter 2.460 SCC, this Agreement may be subject to a declaration <br /> of default and termination at the Snohomish County's or the City's discretion. This <br /> provision shall not affect the Agency's obligations under other federal, state, or local <br /> laws against discrimination. <br /> XVII. NONDISCRIMINATION AND AFFIRMATIVE ACTION <br /> During the performance of any Contract, the Agency and its Subagencies, if any, shall <br /> comply with federal and state laws against discrimination including, where applicable, the <br /> Exhibit A <br /> City of Everett and Everett Gospel Mission <br /> Pallet Shelter Pilot Community Agreement <br /> Page 9 of 33 <br />
