s t J <br /> ORDINANCE NO. <br /> AN ORDINANCE AMENDING CHAPTER 8, SECTION 24, BEING A PART <br /> OF ORDINANCE NO. 3211 , SECTION 79, PROVIDING FOR THE REGULATION <br /> OF RACING OR SPEED TESTS UPON PUBLIC HIGHWAYS OR STREETS OR <br /> ALLEYS OF THE CITY OF EVERETT AND UPON PRIVATE PROPERTY LOCATED <br /> WITHIN THE CORPORATE LIMITS OF THE CITY OF EVERETT, PROHIBITING <br /> THE RACING OR CONTESTING OF MOTOR VEHICLES UPON SUCH PUBLIC <br /> HIGHWAYS OR PRIVATE PROPERTY; DESIGNATING THE VIOLATION OF THE <br /> RESTRICTIONS AGAINST RACING OR COMPARING OF SPEEDS AS RECKLESS <br /> DRIVING, AND PROVIDING FOR THE ISSUANCE OF PERMITS BY THE CHIEF <br /> OF POLICE GOVERNING RACING UPON PRIVATE PROPERTY . <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN : <br /> Section 1 : That in the interest of the public safety, health <br /> and welfare, it is deemed necessary to amend the chapter and <br /> section of the Everett City Code hereinafter referred to, to <br /> prohibit racing upon public highways and private property within <br /> the corporate limits of tine City of Everett. <br /> Section 2: That Chapter 8, Section 24, being Everett City <br /> Code 6. 24.040 (a part of Ordinance No. 3211 , Section 79) be and <br /> it is hereby amended to read as follows : <br /> 8. 24.040 Racing or speed tests within the corporate limits <br /> of the City of Everett - prohibited. No person or persons shall <br /> race any motor vehicle or motor vehicles upon any public highway, <br /> street, alley or thoroughfare of the City of Everett or upon any <br /> private property located within the corporate limits of the City <br /> of Everett without first having obtained the permission of the <br /> Chief of Police of the City of Everett . Any person or persons <br /> guilty of comparing or contesting relative speeds by the simul - <br /> taneous operations of motor vehicles shall be guilty of reckless <br /> driving whether or not such speed is in excess of the maximum <br /> speed provided by law for the point of operation.
