1 ORDINANCE NO. 3840 <br /> 2 AN ORDINANCE licensing and regulating the operations <br /> of GO-KART TRACKS; providing for penalties for violation thereof. <br /> 3 <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 4 <br /> SECTION 1: DEFINITION <br /> 5 <br /> (a) Go-Kart Track is a place used for the operation <br /> 6 of Go-Karts for public use and entertainment . <br /> 7 (b) Go-Kart is a motor propelled, four wheel vehicle <br /> of not more than four horsepower used for the purpose of driving. <br /> 8 <br /> SECTION 2 : It shall be unlawful for any person, firm <br /> 9 or corporation to operate a Go-Kart Track unless he shall have <br /> in full force and effect a license for such purpose issued by <br /> 10 the City of Everett . <br /> 11 SECTION 3: Each applicant for a license shall make <br /> application with the City Clerk upon forms prepared by the City <br /> 12 Clerk and shall pay a fee of $ 15'6:bb provided if the ap- <br /> plication is made after July 1st the fee shall be reduced fifty <br /> 13 percent for the balance of the year. All licenses shall expire <br /> on December 31st of each year. The license shall limit the <br /> 14 number of Go-Karts permitted on the track at any one time to a <br /> number equal to the number of parking spaces for standard motor <br /> 15 vehicles adjacent to and connected to the licensed premises <br /> divided by three. It shall be unlawful for any licensee to permit <br /> 16 the operation of Go-Karts on the licensed track in excess of the <br /> number for which the premises is licensed. <br /> 17 <br /> SECTION 4: (a) No Go-Kart shall be operated with a <br /> 18 horsepower in excess of four horsepower. <br /> 19 (b) All Go-Karts shall be controlled in such a manner <br /> that they shall not exceed the speed limit of 20 mph and no <br /> 20 Go-Kart shall be operated in excess of said speed. <br /> 21 (c) All Go-Karts shall be equipped with mufflers, to <br /> suppress noise, approved by the Chief of Police of the City of <br /> 22 Everett . The Chief of Police shall approve all mufflers which <br /> effectively control noise so as not to be offensive to surround- <br /> 23 ing property owners . <br /> 24 SECTION 5: (a) The Go-Kart track and premises shall <br /> be kept in a neat and clean condition. <br /> 25 <br /> (b) All lighting of a Go-Kart track shall be so con- <br /> 26 structed and operated as to prohibit lights from glaring on or <br /> across surrounding property. <br /> 27 <br /> (c) ' All areas of a Go-Kart track, except the areas <br /> 28 which shall be paved with concrete or asphalt concrete, shall be <br /> so surfaced s to prohibit dust from arising from its use . The <br /> 29 parking area&for standard motor vehicles shall be properly oiled <br /> or hard surfaced. <br /> 30 (d) Each Go-Kart track shall be surrounded by a chain <br /> 31 link fence of a minimum height of 4 feet . <br /> 32 (e) No Go-Kart track shall be operated after 11:00 P .M. <br />
