If sublet work is authorized by City, <br /> Contractor shall require each subcontractor to provide Workers' Compensation <br /> Insurance for its employees, unless such employees are covered by Contractor. <br /> Contractor certifies that he/she is aware of the provisions of Title 51 of the Revised <br /> Code of Washington,which requires every employer to be insured against liability <br /> of Workers' compensation, or to undertake self-insurance in accordance with the <br /> provisions of that Title. Contractor shall comply with the provisions of Title 51 of <br /> the Revised Code of Washington before commencing the performance of the work <br /> under this Agreement. Contractor shall provide the City with evidence of Workers' <br /> Compensation Insurance (or evidence of qualified self-insurance) before any work <br /> is commenced under this Agreement. <br /> B. Commercial General Liability Insurance on an occurrence basis in an amount no <br /> less than$2,000,000 per occurrence and at least$4,000,000 in the annual aggregate, <br /> including but not limited to facilities and operations(including off-site operations), <br /> blanket contractual liability, broad form property damage, bodily injury and <br /> personal and advertising injury and liquor liability. This policy will apply on a <br /> primary basis. Contractor's Commercial General Liability Insurance policy shall <br /> name the City of Everett, its officers, employees, volunteers, and agents as <br /> Additional Insured's with respect to the operations performed under this <br /> Agreement. Prior to any work being performed under this Agreement, Contractor <br /> shall provide the City with a Certificate of Insurance and Endorsements acceptable <br /> to the City Attorney. Receipt by the City of any certificate showing less coverage <br /> than required is not a waiver of Contractor's obligation to fulfill the requirements. <br /> C. Business Automobile Liability Insurance in an amount no less than$1,000,000 per <br /> accident for bodily injury and property damage, extending to any automobile. A <br /> statement certifying that no vehicle will be used in accomplishing this Agreement <br /> may be substituted for the insurance requirement. <br /> D. Fidelity bonds or Crime Insurance no less than $250,000 covering all employees <br /> and officers having access to moneys collected. All employees of Contractor who <br /> have access to or are responsible for the funds generated under this Agreement shall <br /> be bonded by a fidelity bond or insured by a crime policy. Contractor shall be <br /> responsible for any losses attributable to its officers and employees that are not <br /> covered by insurance and/or fidelity bonds. <br /> E. Property Insurance in the amounts deemed sufficient by the City of Everett Risk <br /> Management Department. <br /> Contractor shall immediately notify the City's Risk Manager of any occurrence related to <br /> Contractor' operation of the Facility that may result in a claim asserted against Contractor <br /> and/or the City. <br /> 6. INTEREST: Any interest due to either Contractor or City pursuant to this Agreement shall <br /> accrue at a rate equal to the prime rate publicly announced by Bank of America on the date <br /> such interest began to accrue which shall be thirty (30) days after the date due.
