c. The Contractor shall obtain emergency medical care as soon as reasonably <br /> possible for any member of the public on or at these Premises who is in need <br /> thereof because of illness or injury. The Contractor shall fully cooperate with <br /> the City in the investigation of any accidental injury or death occurring at either <br /> course. The Contractor shall prepare and submit to Parks a detailed report <br /> regarding any safety issue, concern or investigation within one (1)business day <br /> of its occurrence. <br /> 11. Facilities Use Restriction <br /> a. The Contractor shall obtain from the Director prior written approval of(1)any <br /> events or activities not otherwise specifically provided for or authorized under <br /> this Contract or(2) any extraordinary events or activities requiring the exclusive <br /> use of either course or any portion thereof. <br /> 12. Meetings <br /> a. Representatives of the Contractor and the Director shall meet on a monthly <br /> schedule, or at such other times as may be required by the City to review the <br /> Contractor's performance under this Contract,review the monthly reports <br /> submitted by the Contractor and discuss any matters as determined by Parks. <br /> 13. Fees <br /> a. The fees to be charged for the use of the courses shall be set forth by the City <br /> and from time to time will be amended or revised. The fee schedule may <br /> include but not be limited to 1) green fees; 2) golf cart rental fees; 3) equipment <br /> rental fees; and 4)restaurant fees. <br /> b. The Contractor shall at all times maintain a complete list or schedule of prices <br /> charged for all goods and services. Such prices shall be reflective of the <br /> competitive market for similar goods and services and support Parks"best in <br /> value"approach for golf operations. Parks retains the right to direct fee/price <br /> adjustments as may be ordered by the Director. <br /> c. The Contractor shall set forth in each budget recommendation, its recommended <br /> green fees,hand cart rental fees and other equipment rental fees for the <br /> operating year at issue; provided,however, during the term of this Contract, <br /> after written notice to and consultation with the Contractor,the City may change <br /> the green fees,power cart rental fees,hand cart rental fees, other equipment <br /> rental fees or any other fees to be charged by the Contractor. <br /> 14. Business License and Permits <br /> a. The Contractor shall obtain all necessary state and local licenses and permits <br /> necessary to conduct business at the courses and provide a copy to the Parks <br /> Department. The non-labor costs, fees and charges incurred in obtaining and <br /> maintaining these licenses and permits shall constitute Direct Costs. <br /> 15 <br />
