MEDIC TRAINING APARTMENT USE AGREEMENT <br /> This Medic Training Apartment Use Agreement(this"Agreement')is entered <br /> into as of af.44. ,2021,by and between("E'rerett)and Peter Gibson <br /> ("Studentt"). <br /> RECITALS <br /> A. Everett has rented an apartment at 600 Ninth Ave Apartments,located at <br /> 600 9th Ave,Seattle,WA 98104,under a lease contract for August 1,2021 until July 31, <br /> 2021. In this Agreement,the lease contract is called the"Lease,"the time period during <br /> which the Lease is in effect is called the Lease Term,"the apartment under the Lease is <br /> called the"Apartment,"and the landlord under the Lease is called the"Landlord." <br /> Ltas 5hf4' o9//5/) (P6) <br /> II. Student is a student paramedic. The purpose of Student's use of the <br /> Apartment is to provide a temporary residence for Student during a paramedic training <br /> program. Student and Everett have agreed that Student may use the Apartment during <br /> the Leasr Term.as set forth in this Agreement. <br /> AGREEMENT <br /> For good and valuable consideration,the receipt and sufficiency of which is <br /> acknowledged,the parties agree as follows: <br /> 1.Use of Apartment. Student may use the Apartment for the Lease Term. This <br /> includes one bed space. This does not include a parking space. A single parking space <br /> will be shared by all occupants of the Apartment. Student acknowledges that Student has <br /> had an opportunity to receive and review the Lease. <br /> 2.Payment to Everett. Student's share of Lease expenses will be 1/2 of all <br /> monthly rent and all other Lease costs under the Lease for the Lease Term. Everett will <br /> invoice Student monthly,and Student will pay Everett within 30 days after receiving each <br /> invoice.As consideration for the use of the Apartment,Student agrees.unless otherwise <br /> provided in this Agicuuent,to pay such rent and costs for the entire Lease Term, <br /> regardless of whether Student uses the Apartment or completes Student's training <br /> Program <br /> 3.Right to Remove. Everett reserves the right remove Student from the <br /> Apartment for any reason. The Everett Fire Chief and the Student's Fire Chief will <br /> confer about the situation before Everett exercises this right. If Everett exercises this <br /> right.Student will owe rent and costs up to the date of removal. <br /> 4.Use Requirements. Student will comply with the Lease and the rules and <br /> regulations required by the Landlord.Student shall not permit any waste to the Apartment <br /> or engage in any activity that is unlawful or that constitutes a nuisance or that disturbs the <br /> quiet enjoyment of the Apartment or the Apartment building/neighborhood. Everett shall <br /> have no responsibility for Student's safety and/or security,except as may arise from the <br /> gross negligence or intentional misconduct of Everett or its officers or employees. <br /> 5.Liability. Student agrees to defend and indemnify and hold Everett and its <br /> officers and employees harmless from any and all losses,liability,claims or expenses <br /> (including attorneys'fees and costs)arising out of,in connection with,or incident to the <br /> use of the Apartment by Student,whether such losses,liability,claims or expenses sound <br /> in contract,tort,or any other legal theory. Student's obligations under this Section 5 <br /> shall not apply to such losses,liability,claims or expenses to the extent caused by the <br /> negligence of Everett. This Section 5 survives termination or expiration of this <br /> Agreement. <br />
