9 0 <br />City of Everett Hold Harmless Agreement <br />October 25th, 2018 <br />Tony Lee <br />Building Official <br />City of Everett Public Works <br />3200 Cedar Street <br />Everett, WA 98201 <br />Dear Mr. Lee: <br />This letter is intended to formally request that Kimberly Clark Worldwide Inc. be allowed to <br />submit a construction permit application for our Crushed Material Removal and Soil <br />Remediation Project at the former Kimberly Clark Mill Site located at 2600 Federal Avenue <br />in Everett prior to approval by the Planning Department of the SEPA/Land Use Application <br />submitted on October 25th, 2018. <br />We acknowledge to the City, that Kimberly Clark Worldwide Inc. understands the risks <br />associated with submitting the building permit application prior to approval of the <br />SEPA/Land Use Application and further understands that submitting for a building permit <br />does not vest the project or imply that land use approvals will be given. <br />Finally, Kimberly Clark Worldwide Inc. agrees to hold the City of Everett harmless for the <br />loss of paid application fees, design fees, and other fees that may be incurred if the <br />SEPA/Land Use comments cause the project to be altogether denied, affects the timeframe <br />that creates a feasibility issue related to the project or requires additional design <br />modifications subsequent to submittal of the building permit. <br />Sincerely, <br />Bryan Lust <br />Kimberly Clark Everett Site Manager <br />of Hold' Harmless (to be signed by City) <br />
