1 ORDINANCE NO. 3833 <br /> 2 AN ORDINANCE licensing and regulating preparation of <br /> and/or sale of edible merchandise in and from mobile units on <br /> 3 the public streets and public places, providing for bond, <br /> fixing license, and providing for penalty for violation thereof. <br /> 4 <br /> Section 1: No person, firm or corporation shall engage <br /> 5 in the preparation of edible merchandise in or on any mobile <br /> unit while on the public streets and on public property, unless <br /> 6 he shall have first obtained and have in full force and effect <br /> a license for each mobile unit used for said purpose, issued <br /> 7 by the City Clerk of the City of Everett. <br /> 8 Section 2: No person, firm or corporation shall sell <br /> or cause to be sold edible merchandise from a mobile unit to <br /> 9 persons on the public streets, sidewalks and public property <br /> unless he shall have first obtained and have in full force and <br /> 10 effect, a license for each mobile unit used for said purpose, <br /> issued by the City Clerk of the City of Everett. <br /> 11 <br /> Section 3: A mobile unit shall be defined as a vehicle <br /> 12 which can be moved upon the public streets and sidewalks, <br /> including but not limited to trucks, automobiles, trailers . <br /> 13 <br /> Section 4: The applicant shall file application with <br /> 14 the City Clerk upon forms prepared by the City Clerk, together <br /> with a sum of $100.00 as a cash bond, conditioned that the <br /> 15 applicant will not allow refuse and waste to accumulate upon <br /> the streets and sidewalks at or adjacent to the mobile unit, <br /> 16 and conditioned further that in event it becomes necessary for <br /> the City of Everett to sweep or otherwise collect refuse result- <br /> 17 ing from such operation, that the cost of such work shall be <br /> charged against the bond and the license shall be terminated, <br /> 18 unless the bond is maintained at $100.00. <br /> 19 Section 5: The City Clerk, upon receipt of application, <br /> shall forward the same to the Snohomish Health District and <br /> 20 the Chief of Police for investigation. Said investigation shall <br /> be completed and license either issued or rejected by the City <br /> 21 Clerk within days of receipt of application. <br /> 22 Section 6: The license fee shall be $5.00 per day, <br /> $25.00 per month, $250.00 per year. <br /> 23 <br /> Section 7: The licensee shall be permitted to operate <br /> 24 on the city streets of the City of Everett under the direction <br /> of the Chief of Police in such places as will not unduly <br /> 25 interfere with pedestrian and vehicular traffic . <br /> 26 Section 8: The licensee shall comply with all rules, <br /> regulations and ordinances, including all federal, state and <br /> 27 city laws regarding the purity of food and the cleanliness of <br /> the operation. <br /> 28 <br /> Section 9: That in event the licensee shall fail to <br /> 29 comply with the terms and conditions of this ordinance, the <br /> City Council shall have the right to terminate the license <br /> 30 by giving notice to the licensee. In event the licensee shall <br /> desire to appeal such revocation, notice shall be given to the <br /> 31 City Council within 5 days and hearing shall be held by the <br /> City Council within 5 days thereafter. <br /> 32 <br />
