ORDINANCE NO. 3795 AN ORDINANCE providing for the improvement of: McDougal Ave. from Wall St. to a point 215 ft. north of the existing water main on Wall St., by the installation of an 8" cast iron water main, together with the necessary appurtenances and doing such other work as may be necessary to make a complete improvement, all in accordance with a majority petition therefor; creating an enlarged district which shall be divided into a direct benefit district and an indirect benefit district; creating a local improvement district fund; pro- viding for the payment of said improvement by special assessments on the pro- perty in said district under the mode of payment by bonds. WHEREAS, there has been heretofore filed with the City Council of the City of Everett a majority petition of the property owners petitioning for said improvement, and upon examination thereof the said City Council has found the things set forth therein to be true, and WHEREAS, the said petition has been referred to the Commissioner of Public Works to be examined by said Commissioner and the City Engineer, and the Commissioner of Public Works has filed with the City Council all data and information required by law, NOW, THEREFORE; THE CITY OF EVERETT DOES ORDAIN: Section 1: That McDougal Ave. from Wall St. to a point 215 ft. north of the existing water main on Wall St., be improved by the installation of an 81' cast iron water main, together with the necessary appurtenances and doing such other work as may be necessary to make a complete improvement, all according to the plans and specifications prepared under the direction of the City Engineer and which plans and specifications are hereby approved and adopted. Section 2: An enlarged local improvement district is hereby cre- ated, which enlarged district shall include the property hereinafter described. Lot 12, B1k. 688, Plat of Everett Land Co's First Add to Everett; and Lots 12, 13, 14, 15, 16 and 17, Blk. 688, Plat of Everett. Section 3: The entire cost of the improvement shall be borne by and assessed against the property lying within the enlarged district liable therefor, of which 477e of the costs of the improvement shall be borne by and assessed against that portion of the enlarged district lying between the terrain= of the proposed improvement and extending back from the marginal line thereof, to the middle of the block thereof, as provided by law. The remaining portion of the costs and expenses of said improvements shall be distributed and assessed against all of the property included in the remainder of such enlarged district in accordance with the special benefits derived from the improvement without regard to the zone termini method of spreading assessments. The city shall not be liable in any manner for any portion of the costs and expenses of such im- provement except as provided by Chapter 141, Session Laws of 1923, or acts amendatory thereto, and the ordinances of the City of Everett. Section 4: That there is hereby establishe6da local improvement�9 district to be known as Local Improvement District No. , which district shall include all of the property described in Section 2. 1 .
