Y. <br /> ORDINANCE NO. 3795 <br /> AN ORDINANCE providing for the improvement of: <br /> McDougal Ave. from Wall St. to a point 215 ft. <br /> north of the existing water main on Wall St., <br /> by the installation of an 8" cast iron water main, together with the necessary <br /> appurtenances and doing such other work as may be necessary to make a complete <br /> improvement, all in accordance with a majority petition therefor; creating an <br /> enlarged district which shall be divided into a direct benefit district and an <br /> indirect benefit district; creating a local improvement district fund; pro- <br /> viding for the payment of said improvement by special assessments on the pro- <br /> perty in said district under the mode of payment by bonds. <br /> WHEREAS, there has been heretofore filed with the City Council of <br /> the City of Everett a majority petition of the property owners petitioning for <br /> said improvement, and upon examination thereof the said City Council has found <br /> the things set forth therein to be true, and <br /> WHEREAS, the said petition has been referred to the Commissioner <br /> of Public Works to be examined by said Commissioner and the City Engineer, and <br /> the Commissioner of Public Works has filed with the City Council all data and <br /> information required by law, <br /> NOW, THEREFORE; THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: That <br /> McDougal Ave. from Wall St. to a point 215 ft. <br /> north of the existing water main on Wall St., <br /> be improved by the installation of an 81' cast iron water main, together with the <br /> necessary appurtenances and doing such other work as may be necessary to make <br /> a complete improvement, all according to the plans and specifications prepared <br /> under the direction of the City Engineer and which plans and specifications are <br /> hereby approved and adopted. <br /> Section 2: An enlarged local improvement district is hereby cre- <br /> ated, which enlarged district shall include the property hereinafter described. <br /> Lot 12, B1k. 688, Plat of Everett Land Co's <br /> First Add to Everett; and Lots 12, 13, 14, 15, <br /> 16 and 17, Blk. 688, Plat of Everett. <br /> Section 3: The entire cost of the improvement shall be borne by <br /> and assessed against the property lying within the enlarged district liable <br /> therefor, of which 477e of the costs of the improvement shall be borne by and <br /> assessed against that portion of the enlarged district lying between the terrain= <br /> of the proposed improvement and extending back from the marginal line thereof, <br /> to the middle of the block thereof, as provided by law. The remaining portion <br /> of the costs and expenses of said improvements shall be distributed and assessed <br /> against all of the property included in the remainder of such enlarged district <br /> in accordance with the special benefits derived from the improvement without <br /> regard to the zone termini method of spreading assessments. The city shall not <br /> be liable in any manner for any portion of the costs and expenses of such im- <br /> provement except as provided by Chapter 141, Session Laws of 1923, or acts <br /> amendatory thereto, and the ordinances of the City of Everett. <br /> Section 4: That there is hereby establishe6da local improvement�9 <br /> district to be known as Local Improvement District No. , which district <br /> shall include all of the property described in Section 2. <br /> 1 . <br />
