<br />1.1 DESCRIPTION
<br />A This Section includes administrative and procedural requirements for handling
<br />requests for substitutions made after award of the Contract
<br />1.2 RELATED SECTIONS
<br />A The followino Sections contain requirements that relate to this Section.

<br />13 DEFINITIONS
<br />A Definitions in flit.=, Article do not change or modify the meaning of other terms
<br />used in the Contract Documents
<br />B. Substitutions: Changes in products, materials, equipment, and methods of
<br />construction required by the Contract Docuo-fents proposed by the Contractor
<br />after award of the Contract are considered to be requests for substitutions. The
<br />following are not considered to be requests for substitutions:
<br />i. Substitutions requested durrncl the bidding, and accepted by Addendum
<br />prior to award of the Contract, are included in ',lie Contract Documents
<br />and are not subject to requircnt :rife=. specified to this Section fof
<br />SDtiStitl.rtlanS.
<br />2 Revisions to the Contract Documents reoceste;i by the Owner or
<br />Architect
<br />3- Specified options or products and construction methods mauled in the
<br />Contract Documents
<br />4 The Contractor's determination of and compliance v✓ilh governing
<br />regulations and orders issued by governing authorities-
<br />C: Substitution Provisions
<br />1 The Owner has no obligation to entemain subshtutfans
<br />2. Substitutions will not be considered if they are indicated or mip lied on
<br />shop drawing, product data or sample submittals All requests for
<br />subslilufion shall be by separate Written request
<br />3 Substitutions e,III not be considered unless a net reduction in Contract
<br />or Co Itract Time results to Ovmer=. benefit, including redesign casts.

<br />considered for each product
<br />14 SUBMITTALS
<br />A. Substitution Request Submftt :i The Architect will consider requests for
<br />substitution if received within GO days after commencement of the Work
<br />Requests received more than 60 days after commencement of the Work may be
<br />considered gr re;ectcd at the discretion of the Architect
<br />B. The Contractor is required to prepare and submit three (3) copies of the required
<br />data for time first manufacturer listed or procedure listed in the specifications
<br />section With reference to all of the following areas: the substance and function
<br />considering quality, workmanship, economy of operation, durability and suitability
<br />for purposes intended including the size, rating performance, LEED.
<br />compliance, and cost. All submissions must include all the required data for the
<br />first listed manufacturer or procedure as specified. as Well as the required data
<br />for the Proposed Substitution. This will enable the Architect to determine if the
<br />proposed Substitution is or is not substantially equal to the first listed
<br />manufacturer or procedure-
<br />1 Identify the product or the fabricahon or installation method to be replaced
<br />In each request- Include related Specification Section and Drawing
<br />numbers.
<br />2. Provide complete documentation showing compliance With the
<br />requirements for substitutions, and the following information, as
<br />appropriate:
<br />a Coordination information, including a list of changes or
<br />modifications needed to other parts of the Wort; and to
<br />construction performed by separate contractors that will be
<br />necessary to accommodate the proposed Substitution.
<br />b. A detailed comparison chart of significant qualities of the proposed
<br />substitution with those of the Work specified. Significant qualities
<br />may include elements, such as performance, weight, size,
<br />durability, and visual effect.
<br />c Product Data, including Shop Drawings and descriptions of
<br />products and fabrication and installation procedures.
<br />d. Samples, where aPpfcahle or requested.
<br />e. A statement indicating the effect an the Contractor's Construction
<br />Schedule or CK11 Schuadule compared to the schedule withoklt
<br />approval of the Equal or Substitution. Indicate the effect on
<br />overall Contract Time.
<br />f. Cost information, broken down, including a proposal of the net
<br />change, if any in the Contract Sum.
<br />g. The Contractor's certification that the. proposed Substitution
<br />conforms t0 requirements in the Contract Documents in every
<br />respect and is appropriate for the applications indicated.
<br />ten. Substitution requests Shall include a signed waiver by the
<br />Contractor for change in time Contract Time or Contract Sum
<br />because of the following:
<br />I) Substitution failed to perform adequately.
<br />2) Substitution required changes in on other elements of the
<br />Work.
<br />3) Substilution caused problems in interfacing With otl;er
<br />elements of the Work"
<br />A) Substitution was determined to be unacceptable by
<br />authorities having jurisdiction.
<br />C. Architect's Action.
<br />i.. 1t. it the opinion: of the Architect, the u'Sstitution request is Incomplete or
<br />has insufficent data to enable a full and thorough review of the interided
<br />substitution, the substitution may be summarily refused and determined to
<br />be unacceptable.
<br />2, if necessary, the Architect will request additional information or
<br />documentation for evaluation within seven (7) days of receipt of the
<br />Original request for substitution request- The Architect will notify tile the
<br />Owner of recommended acceptance or rejection of the proposed equal ar
<br />substitution, within tourteer, (14) days of receipt of the request. or seven
<br />(7) days of receipt of additional information or documentation. Whichever
<br />is later. The Owner Will give final acceptance or rejection not less than
<br />seven (7) days after notification_
