Federal Transit Administration Clauses <br />Any mitigation measures agreed on will be incorporated by reference and <br />made part of the Underlying Agreement and any Amendments thereto; <br />ii. Any deferred mitigation measures will be incorporated by reference and made <br />part of the Underlying Agreement and any Amendments thereto as soon as <br />agreement with the Federal Government is reached; and <br />10) Any mitigation measures agreed on will not be modified or withdrawn without the written <br />approval of the Federal Government. <br />43. FEDERAL "$1 COIN" REQUIREMENTS <br />The City of Everett agrees to comply with section 104 of the Presidential $1 Coin Act of 2005, 31 U.S.C. <br />§ 5112(p), therefore its equipment and facilities will be fully capable of accepting and dispensing $1 <br />coins when coins or currency are required to use that equipment or those facilities, and it will display <br />signs and notices of the $1 coin capability of its equipment and facilities on its premises, including <br />vending machines, where coins or currency are used. <br />44. CENTERS FOR DISEASE CONTROL AND PREVENTION ORDER ON <br />REQUIREMENTS FOR PERSONS TO WEAR MASKS WHILE ON <br />CONVEYANCES AND AT TRANSPORTATION HUBS <br />(a) Compliance with CDC Mask Order. The Centers for Disease Control and Prevention ("CDC") Order of <br />January 29, 2021, titled Requirement for Persons to Wear Masks While on Conveyances and at <br />Transportation Hubs ("CDC Mask Order"), is within the meaning of "Federal Requirement" as that term <br />is defined in this Master Agreement. One of the objectives of the CDC Mask Order is "[m]aintaining a <br />safe and operating transportation system." The Recipient agrees that it will comply, and will require all <br />Third -Party Participants to comply, with the CDC Mask Order. <br />(b) Enforcement for non-compliance. The Recipient agrees that FTA may take enforcement action for <br />non-compliance with the CDC Mask Order, including: <br />(1) Enforcement actions authorized by 49 U.S.C. § 5329(g); <br />(2) Referring the Recipient to the CDC or other Federal authority for enforcement action; <br />(3) Enforcement actions authorized by 2 CFR §§ 200.339 — 340; and <br />(4) Any other enforcement action authorized by Federal law or regulation. <br />33 <br />
