• <br /> Exhibit 10 Go Sync Map <br /> Exhibit 11 Exhibit List,dated January 18,2018 <br /> Based upon a review of record,the following findings of fact and conclusions of law hereby <br /> constitute the basis of the decision of the Everett Violations Hearing Examiner. <br /> FINDINGS OF FACT <br /> 1. James and Veronica Caudle(Respondents)are the owners of property at 2322 Cedar Street, <br /> Everett,Washington(subject property),which is in an R-2, Single-Family Medium Density <br /> Residential zone. Gary A.MacMillan(Respondent)is a tenant of the residential structure <br /> located on the subject property and was responsible for the construction work conducted on <br /> the structure. Gary MacMillan is the adult son of James and Veronica Caudle. (Exhibit#9, <br /> Snohomish County Assessor's record dated January 10, 2018) (Exhibit#10, Go Sync Map) <br /> 2. On October 17,2017, Chief Inspector Ted de Budden,City of Everett Building Division, <br /> conducted an inspection of the subject property and observed and photographed construction <br /> work being conducted on a structure attached to the residential structure on site. <br /> Construction alterations observed on the exterior surfaces included:new exterior sheathing, <br /> roof cornices and evidence of roof repair. Interior construction alterations as observed <br /> through windows facing a public sidewalk included:open stud walls,exposed electrical <br /> wiring and other evidence of new construction activity. Inspector de Budden determined <br /> that the construction work had been done without required City permits and posted a stop <br /> work order on the structure. On November 7,2017,Inspector de Budden reinspected the subject property and observed <br /> that the stop work order had been removed from the residential structure. He referred the <br /> matter to the City of Everett Code Enforcement unit for enforcement action. (Exhibit#7, <br /> City of Everett Inspection Report, dated November 7, 2017) (Exhibit#, Email from Ted de <br /> Budden, dated November 7, 2017) (Testimony of Code Enforcement Officer Cunningham) <br /> 4. In response to a complaint of construction work conducted without required City permits <br /> and violation of a stop work order,City of Everett Code Enforcement Officer Don <br /> Cunningham conducted an inspection of the subject property on November 14,2017. While <br /> on site,Officer Cunningham observed and photographed that house wrap had been applied <br /> to the exterior surface of the residential structure. Officer Cunningham was informed by <br /> Respondent MacMillan that he was conducting repair work to the structure and was unaware <br /> of the requirement for permits. Mr.MacMillan said he did not know who removed the stop <br /> work order from the structure. Upon research of City records,Officer Cunningham <br /> determined that permits had not been applied for or obtained by the Respondents for the <br /> construction alterations performed on the residential structure. On November 15,2017,the City issued a violation citation to the Respondents for violations <br /> of: International Property Maintenance Code(IPMC) 1061 Unlawful Acts as adopted by <br /> 2' 3 <br /> 3 <br />
