Upon review of the application by City Staff, it was found that a portion of the <br />proposed sign does not meet zoning code requirements as it contains an electronic messaging center. <br />Section 36.080 of the City's Zoning Code states that "...Except as othenvise permitted by tliis Section, no signs <br />shall have b/inking, (lashing or fluttering liahts, or other i/lumination devices which have a changing light intensify <br />or brightness, or whrch are so constructed and operated as to create an appearance or ill�sion of w�iting or <br />printing, except tor char,ging message signs." <br />Pursuant to ihe authority granted the Planning Director by Section 41.040 of the Zoning Code, the Plannir.g <br />Director has determined that electronic/changing message signs may be permitted as an exception to the <br />prohibition on signs which have a changing light intensity or brighiness, subject to the following criteria: <br />• Any approved changing message sign must comply with the provisions of Chapter 36 including Section <br />36.Od0 which pertain to light intensity, glare, and safe vision of vehicles and pedestrians. <br />• The sign c2tegory for the zone in wi:ich (he sign is proposed must allow for lhe illumination of signs. (Sign <br />Categories A, B, and C). <br />• The maximum sign area for a chanyina/eleclronic me,sage center, which ia freestanding or wall mounted, <br />shall be no greater than 104% of the maaimum total allowabte sign area for a freestanding sign, designated by <br />the underlying zone. <br />• No changing/electronic message center sign shall exceed 7.5 square feet. <br />• Prior to any approval of any new sign permit proposed to be installed on a premise, wh:cli contains a <br />nonconforming sign, one nonconforming sign shail be removed for each new sign instailed. <br />• if no changing/electronic message component is proposed in the sign permit application, then the provis�ons <br />of the underlying sign category shall apply. <br />The sign proposed (Plan Check #S0012-010) shows a message center that is 48" X 64" which is not consistent <br />with the Planning Director's Decision and is therefore denied. Please provide a revised sign proposal, drawn to <br />scale so that ii may be reviewed for compliance with all other sign code requirements, and consistent with ihe <br />above crteria so that a permit may be approved that meets all zoning code requirements. <br />This is an administrative decision appealable to the City's Land Use fiearing Examiner. Pursuant to Ord.#2136- <br />96, any appeal must be filed within 14 calendar days of the date of issuance of this decision.
