REAS, the parties of the second part (Grantees) own and have title to the real estate <br />02 Oakes Avenue, Everett, Snohomish County, Washington, described as follows: <br />3 31 AND 32, BLOCK 422, PLAT OF EVERETT DIVISION K, <br />ORDING TO THE PLAT THEREOF RECORDED IN VOLUME 5 OF <br />FS, PAGE 5, RECORDS OF SNOHOMISH COUNTY, WASHINGTON. <br />IATE IN THE COUNTY OF SNOHOMISH, STATE OF WASHINGTON. <br />Snohornish County Tax Parcel No. 00437942203 100 <br />WHEREAS, said properties are adjacent to each other, with the Grantees' property <br />located due north of the Grantors' property, and sharing a common boundary extended generally <br />east to west for 120'. <br />WHEREAS, the Grantees are replacing a garage located on the Grantees' property such <br />that the eaves of the new garage extend over the property line into the airspace above the <br />Grantors' property. <br />WHEREAS a grant of easement is required to accommodate the overhang. <br />NOW, THEREFORE, in pursuant to said agreement and for and in consideration of the <br />sum of Ten Dollars and 00/100 ($10.00) and other valuable consideration, paid by the Grantees <br />to the Grantors, the receipt and sufficiency of which is hereby acknowledged, and of the <br />covenants, agreements, conditions and stipulations therein contained, it is mutually covenanted, <br />stipulated and agreed by and the parties as follows: <br />1. Grant by First Parties (Grantors). The parties of the first part (Grantors) <br />hereby grant to the parties of the second part (Grantees), their heirs and assigns, a perpetual three <br />foot (Y) airspace easement beginning at the northeast comer of Lot 30, extending generally to <br />the east along the north boundary of the Grantor's Lot 30 for the distance of forty feet (40'). This <br />easement shall be for the purpose of accommodating the overhang and maintenance of the eaves <br />on the Grantee's garage. <br />2. Grant by Second Parties (Grantees). None. <br />3. Appurtenant.
