Federal Transit Administration Clauses <br /> e) Asian-Indian Americans -which includes persons whose origins are from India, <br /> Pakistan and Bangladesh; <br /> f) Women - regardless of race, ethnicity or origin; and, <br /> g) Other- individuals found to be socially and economically disadvantaged by the <br /> Small Business Administration (SBA) pursuant to Section 8(a) of the Small <br /> Business Act. <br /> d. Disadvantaged Business Enterprises <br /> 1) This contract is subject to the requirements of Title 49, Code of Federal Regulations, <br /> Part 26, Participation by Disadvantaged Business Enterprises in Department of <br /> Transportation Financial Assistance Programs. The national goal for participation of <br /> DBEs is 10%. The agency's overall goal for DBE participation is 2%. A separate contract <br /> goal has not been established for this procurement. <br /> 2) The successful bidder/Bidder will be required to report its DBE participation obtained <br /> through race-neutral means throughout the period of performance. <br /> 3) The contractor must promptly notify the City of Everett,whenever a DBE subcontractor <br /> performing work related to this contract is terminated or fails to complete its work, and <br /> must make good faith efforts to engage another DBE subcontractor to perform at least <br /> the same amount of work. The contractor may not terminate any DBE subcontractor <br /> and perform that work through its own forces or those of an affiliate without prior <br /> written consent of the City of Everett. <br /> e. Affirmative Efforts to Solicit DBE Participation <br /> DBE firms shall have equal opportunity to compete for and perform subcontracts which the <br /> Contractor enters into pursuant to this contract. Contractors are encouraged to: <br /> 1) Advertise opportunities for subcontractors or suppliers in a manner reasonably designed <br /> to provide DBEs capable of performing the work with timely notice of such <br /> opportunities. All advertisements should include a provision encouraging participation <br /> by DBE firms and may be done through general advertisements (e.g. newspapers, <br /> journals, etc.) or by soliciting bids/Bids directly from DBEs. <br /> 2) Utilize the services of available minority community-based organizations, minority <br /> contractor groups, local minority assistance offices and organizations that provide <br /> assistance in the recruitment and placement of DBEs and other small businesses, such <br /> as the Office of Minority and Women's Business Enterprises listed below. <br /> 3) Establish delivery schedules,where requirements of the contract allow,that encourage <br /> participation by DBEs and other small businesses. <br /> 4) Achieve attainment through joint ventures. <br /> In the absence of a mandatory goal, all DBE participation that is attained on this project will be <br /> considered as "race neutral" participation and will be reported as such. <br /> 10 <br />
