WASHINGTON <br />LANDSCAPE BUFFER EASEMENT <br />FOR AND IN CONSIDERATION OF valuable consideration, the receipt of which is hereby <br />acknowledged, Michael D. Killmer and Jennifer Michelle Villmer ("Grantee'), as owners of 2117 <br />Lincoln Street, City of Everett, State of Washington, of 98203 grants, conveys and warrants to <br />Vuicestream PCS m Corporation, a Delaware corporation. ("Grantee"), for the purposes set forth herein, <br />a Lanhiscape Buffer Easement ("Fasement") under, across and over die following real property (`Property'') <br />in Snohomish County, Washington as described and incorporated by this reference in the attached Exhibit <br />A. Except as may be otherwise set forth herein, Grantee's rights shall be exercised upon that portion of the <br />Property as described and incorporated by this reference in the attached Exhibit B. <br />1. Purpose. Snohomish County is requiring as a condition to releasing Grantee's building permit <br />for the construction of its telecommunications facility ("Site") on the Property, a landscape buffer to <br />mitigate the effect of the Site on the wetlands located on the Property. 11re Easement location and <br />dimensions are described in the attached Exhibit B. <br />2. Grantor's Use of Easement. Grantor reserves the right to use the Easement for any purpose <br />not inconsistent with the rights herein granted to Grantee, provided that Grantor shall not construct or <br />maintain any building or other structure on the Easement which would interfere with the exercise of the <br />rights herein granted. Grantor shall not dig, tunnel, remove any trees or use any other form of construction <br />activity on the Property which would disturb Grantee's rights with out prior approval of Grantee, which <br />approval shall not be unreasonably delayed, withheld, conditioned or denied. <br />3. Indemnity.
