EVERETT <br />►V.TEVI:u.«i ri <br />ORDINANCE NO. <br />An ORDINANCE Authorizing the Editing of the Everett Municipal Code for Gender Neutrality as <br />Authorized under RCW 35.21.500 <br />WHEREAS, <br />A. The Everett Municipal Code (EMC) contains provisions that contain outdated and unnecessary <br />references to gender. <br />B. The need to use gender neutral terms in statutes and ordinances has been recognized in <br />Washington for many years. For example, the Washington State Legislature in 1983 in RCW <br />44.04.210 required that "All statutes, memorials, and resolutions enacted, adopted, or amended <br />by the legislature after July 1, 1983, shall be written in gender -neutral terms unless a specification <br />of gender is intended." <br />C. RCW 35.21.500(1) authorizes the codification of ordinances, including but not limited to "[e]diting <br />ordinances to the extent deemed necessary or desirable, for the purpose of modernizing and <br />clarifying the language of such ordinances, but without changing the meaning of any such <br />ordinance." <br />D. The purpose of this ordinance is to authorize the editing of the EMC as necessary to achieve <br />gender neutrality, so long as such edits do not change meaning. <br />NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br />Section 1. As provided for in RCW 35.21.500(1), City staff is authorized to edit the EMC to <br />modernize the EMC to achieve gender neutrality, so long as such edits do not change meaning. <br />Below are examples of the edits authorized under this ordinance: <br />EMC 2.10.010. The mayor shall be the chief executive and administrative officer of the city in <br />charge of all departments and employees. The mayor shall appoint and remove all appointive <br />officers and all employees under N-s the mayor's jurisdiction or may authorize a head of a <br />department or officer responsible to 4im the mayor to appoint and remove subordinates in such <br />department or office. <br />EMC 6.04.110.A It is the responsibility of the manager of Everett's department of animal control <br />and those "„e�she such manager designates to enforce the provisions of this chapter. <br />EMC 2.44.010 If there is a need for a police escort or if one is requested for a funeral procession <br />
