EVERETT WASHINGTON ORDINANCE NO. 3833-21 An ORDINANCE Authorizing the Editing of the Everett Municipal Code for Gender Neutrality as Authorized under RCW 35.21.500 WHEREAS, A. The Everett Municipal Code (EMC) contains provisions that contain outdated and unnecessary references to gender. B. The need to use gender neutral terms in statutes and ordinances has been recognized in Washington for many years. For example, the Washington State Legislature in 1983 in RCW 44.04.210 required that "All statutes, memorials, and resolutions enacted, adopted, or amended by the legislature after July 1, 1983,shall be written in gender-neutral terms unless a specification of gender is intended." C. RCW 35.21.500(1)authorizes the codification of ordinances,including but not limited to"[e]diting ordinances to the extent deemed necessary or desirable, for the purpose of modernizing and clarifying the language of such ordinances, but without changing the meaning of any such ordinance." D. The purpose of this ordinance is to authorize the editing of the EMC as necessary to achieve gender neutrality, so long as such edits do not change meaning. NOW,THEREFORE,THE CITY OF EVERETT DOES ORDAIN: Section 1. As provided for in RCW 35.21.500(1), City staff is authorized to edit the EMC to modernize the EMC to achieve gender neutrality, so long as such edits do not change meaning. Below are examples of the edits authorized under this ordinance: EMC 2.10.010.
