<br /> Presidential Disaster Declaration # FEMA-4593-DR-WA Severe Winter Storm, Straight-line Winds, Flooding, Landslides, and
<br /> Mudslides To provide funds to the SUBRECIPIENT for the emergency work and the repair or replacement of disaster-damaged
<br /> facilities. as approved by FEMA in project worksheets describing eligible scopes of work and associated funding. The
<br /> DEPARTMENT is the Recipient and Pass-through Entity of the Presidential Disaster Declaration # FEMA-4593-DR-WA Severe
<br /> Winter Storm, Straight-line Winds, Flooding, Landslides, and Mudslides. and FEMA State Agreement, which are incorporated by
<br /> reference, and makes a subaward of Federal award funds to the SUBRECIPIENT pursuant to this Agreement. The SUBRECIPIENT
<br /> is accountable to the DEPARTMENT for use of Federal award funds provided under this Agreement and the associated matching
<br /> funds.
<br /> IN WITNESS WHEREOF, the DEPARTMENT and SUBRECIPIENT acknowledge and accept the terms of this Agreement, references and
<br /> attachments hereto and have executed this Agreement as of the date and year written below. This Agreement Face Sheet, Special Terms
<br /> and Conditions (Attachment 1), General Terms and Conditions(Attachment 2), Project Worksheet Sample(Attachment 3), Washington State
<br /> Public Assistance Applicant Manual dated April 8, 2021 (Attachment 4), and all other documents, exhibits and attachments expressly
<br /> referenced and incorporated herein contain all the terms and conditions agreed upon by the parties and govern the rights and obligations of
<br /> the parties to this Agreement. No other understandings, oral or otherwise, regarding the subject matter of this Agreement shall be deemed to
<br /> exist or to bind any of the parties.
<br /> In the event of an inconsistency in this Agreement, unless otherwise provided herein, the inconsistency shall be resolved by giving
<br /> precedence in the following order:
