RED B tT .,F'u.TE "k. 4 S p OCIA xa rtY`�. <br /> June 12, 2019 <br /> Tony Lee <br /> Building Official <br /> City of Everett Public Works <br /> 3200 Cedar Street <br /> Everett, WA 98201 <br /> RE: Hold Harmless Agreement <br /> Dear Mr. Lee: <br /> This letter is intended to formally request that Emory's Lakehouse LLC be allowed to submit <br /> construction permit applications for our "Emory's Valet parking Lot - 12011 19th Ave. SE <br /> prior to approval by the Planning Department of the Land Use Application (Landscape <br /> Modification) submitted on 06.20.19. <br /> We acknowledge to the City, that the Owner (Emory's Lakehouse LLC) understands the <br /> risks associated with submitting the building permit application prior to approval of the Land <br /> Use Application and further understands that submitting for a building permit does not vest <br /> the project or imply that land use approvals will be given. <br /> Finally, the owner agrees to hold the City of Everett harmless for the loss of paid application <br /> fees, design fees, and other fees that may be incurred if the Land Use comments cause the <br /> project to be altogether denied, affects the timeframe that creates a feasibility issue related <br /> to the project or requires additional design modifications subsequent to submittal of the <br /> building permit. <br /> Sincerely, <br /> axter, A.I.A. <br /> Architect <br /> Acceptance of Hold Harmless (to be signed by City) Date <br />
