Section 2. Adoption of Policy. The City Council hereby finds it to be in the public interest to allow <br />the use of electronic records and electronic signatures for the City's business to the fullest extent allowed <br />by law. The City Electronic Signature Policy is hereby adopted as set forth in the attached Exhibit "A" to <br />this Resolution. <br />Section 3. Policy Implementation and Amendment. The City Council hereby authorizes the Mayor <br />to adopt any necessary administrative policies or processes to implement the use of electronic signatures <br />by the City consistent with the policies adopted in Section 2, and in compliance with state law, as existing <br />or hereafter amended. The City Council hereby acknowledges that future amendments to the policy set <br />forth in Exhibit "A" to this Resolution, if any, may be made administratively by the Mayor, and will be <br />based on changes in law, rule, or business practice. <br />Section 4. Recognizing the Validity of Certain Electronic Signatures. The City Council hereby <br />recognizes that electronic signatures are valid, except as required otherwise by law, to the same extent a <br />physical signature would be valid, if electronic signatures comply with all applicable state and/or federal <br />laws as well as the Policy adopted by this Resolution. <br />Section 5. Authorized Signors. To the fullest extent consistent with the City Charter and City <br />ordinances and resolutions, the City Council authorizes the Mayor, Deputy Mayor, Mayor Pro Tempore, <br />Department Directors, City Clerk, City Attorney, and their designees, to use electronic signature platforms <br />that are in compliance with the Policy adopted by this Resolution, to affix electronic signatures to <br />electronic records. <br />Section 6. Severability. If any section, sentence, clause or phrase of this Resolution should be held <br />to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality <br />shall not affect the validity or the constitutionality of any other section, sentence, clause or phrase of this <br />Resolution. <br />Section 7. Effective Date.
