Liz <br /> EVERETT <br /> WASHINGTON <br /> RESOLUTION NO. 7728 <br /> A RESOLUTION Declaring Emergency and Special Market Conditions Regarding Supply Chain <br /> Disruptions for the Purpose of Waiving Competitive Bidding Requirements <br /> WHEREAS, <br /> A. On March 4, 2020,the City Council adopted Resolution 7486,which waived competitive bidding <br /> requirements in response to the COVID-19 pandemic. <br /> B. The pandemic's effects on the supply chain are causing significant increases in lead time for <br /> obtaining critical equipment and materials used in the operation and maintenance of the City's <br /> water,sewer, and stormwater utilities. Because of the extended lead times and other factors, <br /> the City is currently unable in some cases to use its normal competitive bidding process to <br /> obtain the necessary minimum levels of material and equipment in time for proper operation <br /> and maintenance. <br /> 1. Water Utility. Examples of the types of equipment and materials so affected include <br /> without limitation:treatment chemicals,treatment process related equipment or rental <br /> of such equipment, pipe, service connections,valves,appurtenances, hydrants, <br /> couplings, and other maintenance, repair, and operating supplies. <br /> 2. Sewer and Stormwater Utility. Examples of the types of equipment and materials so <br /> affected include without limitation:treatment chemicals,treatment process related <br /> equipment or rental of such equipment, pipes, catch basins, manholes, appurtenances, <br /> treatment chemicals and other maintenance, repair, and operating supplies. <br /> C. The pandemic's effects on the supply chain are causing significant increases in lead time for <br /> COVID-19 tests. <br /> D. The supply chain disruptions described above are an emergencies that represent unforeseen <br /> circumstances beyond the control of the City of Everett that present a real, immediate threat to <br /> the proper performance of essential functions. <br /> E. The supply chain disruptions described above represents special market conditions because the <br /> conditions of the marketplace for equipment and materials have been altered so much that <br /> normal competitive processes are no longer practical. <br />
