B. It to be in the public interest to allow the use of electronic records and electronic <br /> signatures for City business to the fullest extent allowed by law. <br /> Section 2. Adoption of Policy. The City Council hereby finds it to be in the public interest to allow <br /> the use of electronic records and electronic signatures for the City's business to the fullest extent allowed <br /> by law. The City Electronic Signature Policy is hereby adopted as set forth in the attached Exhibit "A" to <br /> this Resolution. <br /> Section 3. Policy Implementation and Amendment. The City Council hereby authorizes the Mayor <br /> to adopt any necessary administrative policies or processes to implement the use of electronic signatures <br /> by the City consistent with the policies adopted in Section 2, and in compliance with state law, as existing <br /> or hereafter amended. The City Council hereby acknowledges that future amendments to the policy set <br /> forth in Exhibit "A" to this Resolution, if any, may be made administratively by the Mayor, and will be <br /> based on changes in law, rule, or business practice. <br /> Section 4. Recognizing the Validity of Certain Electronic Signatures. The City Council hereby <br /> recognizes that electronic signatures are valid, except as required otherwise by law,to the same extent a <br /> physical signature would be valid, if electronic signatures comply with all applicable state and/or federal <br /> laws as well as the Policy adopted by this Resolution. <br /> Section 5. Authorized Signors. To the fullest extent consistent with the City Charter and City <br /> ordinances and resolutions, the City Council authorizes the Mayor, Mayor Pro Tempore, Department <br /> Directors, City Clerk, City Attorney, and their designees, to use electronic signature platforms that are in <br /> compliance with the Policy adopted by this Resolution,to affix electronic signatures to electronic records. <br /> Section 6. Severability. If any section, sentence, clause or phrase of this Resolution should be held <br /> to be invalid or unconstitutional by a court of competent jurisdiction,such invalidity or unconstitutionality <br /> shall not affect the validity or the constitutionality of any other section, sentence,clause or phrase of this <br /> Resolution. <br /> Section 7. Effective Date.
