d. MLE will reimburse Subrecipient up to an additional $5,000.00 who supply a <br /> recognized BMLE instructor for 80 hours. For instructor services less than 80 <br /> hours, a sum of $500.00 per day will be awarded. The additional award is <br /> available for use commencing on June 1, 2022. <br /> e. The Subrecipient may not exceed the approved budget which was <br /> proposed by the Subrecipient as part of the Subrecipient's Subrecipient <br /> Grant Application that was accepted by MLE. The Subrecipient's budget <br /> is attached to this agreement (Attachment "B"). If the Subrecipient would <br /> like to change the allocations of funds to the original budget, a budget <br /> amendment request must be sent in writing via email to MLE in advance <br /> of the expense being incurred. <br /> f. If a boat, a vehicle, or equipment is used partially for other purposes, costs <br /> must be pro-rated for that portion of their use that is for Recreational <br /> Boating Safety Act purposes. <br /> 8.4 Conditions Precedent to Partial Progress Payment(s). MLE shall not be obligated to <br /> make partial progress reimbursement payment(s) hereunder until the appropriate <br /> supporting documentation and reimbursement form has been submitted no less than on a <br /> quarterly basis of the percentage of Project completion has have been received, reviewed <br /> and approved by MLE. In no event shall MLE disburse more than fifty percent(50%) of the <br /> amount indicated in Section 9.2— Grant Funds as progress payments. <br /> 8.5 Conditions Precedent to Final Payment. MLE shall not be obligated to make final <br /> payment hereunder until the following have been completed or supplied: <br /> a. Supporting documentation in form and content determined by MLE, has been <br /> received reviewed and approved by MLE; and <br /> b. Subrecipient provides summary of work achieved pursuant to the SOW as <br /> provided with the grant application to MLE with funding the Project; and <br /> c. Inspection and approval of the Project by MLE Program staff. <br /> SECTION 9: REIMBURSEMENT AND PAYMENT TERMS <br /> 9.1 Federal Fund Approval. MLE has received a grant from the United States Department of <br /> Homeland Security, United States Coast Guard as described pursuant to 2 CFR 200.331 <br /> on Exhibit B. In accordance with 2 CFR 200.330, MLE's determination is that the other <br /> party to this contract is a subrecipient and is therefore a subrecipient of federal funds. <br /> 9.2 Grant Funds. Upon approval by its governing body or bodies, MLE shall provide federal <br /> grant funds in the amount of$15,477.90 to the Subrecipient to fund the Project. <br /> 9.3 Match. The Subrecipient shall contribute at least twenty-five (25%)of the total project cost <br /> as cost sharing or non-federal match as described in the approved project budget. Such <br /> cost sharing or match may be provided as cash costs or in-kind services provided such <br /> services are reasonable and necessary for grant purposes. Vessel Registration Fees <br /> cannot be used as match. These are non-reimbursable items.
