1. Upon City Council designation of the Museum as the "historic non-profit <br /> entity"to receive the Van Valey House,transfer of the Van Valey House to the Museum by <br /> the City by quit claim deed without payment by the Museum is in compliance with and <br /> required by Section 1.A.2 of the Donation Agreement. <br /> 2. Effective as of the date of recording of the quit claim deed transferring the Van <br /> Valey House to the Museum, the Donation Agreement in its entirety is hereby terminated. <br /> As of such recording, neither the City nor the Morrows will have any right, title or interest <br /> in the Van Valey House or in any personal property in the Van Valey House. <br /> [signature pages attached] <br /> 3 <br />
