understands vocational benefits and services include vocational assessment, vocational plan <br /> development, and job retraining. <br /> 6. Lump Sum Payment <br /> In consideration of the release above, and for this agreement, the Self-Insured Employer agrees <br /> to pay the Claimant a lump sum of$300,000.00. This lump sum is being paid to the Claimant for <br /> disabilities related to the Claimant's work-related conditions which will interfere with the <br /> Claimant's ability to engage in gainful employment for the remainder of the Claimant's life. None <br /> of this amount should be considered as payment to segregate any condition which may be related <br /> to the Claim outlined above. The agreement is for a lump sum amount of$300,000.00 and will <br /> be paid as a single lump sum pursuant to RCW 51.04.063. <br /> Pursuant to RCW 51.32.040 and RCW 74.20A.260,the lump sum amount is subject to collection <br /> action by the Division of Child Support (DCS). <br /> Lifetime Expectancy Award <br /> The parties agree the $300,000.00 lump sum is intended to compensate the Claimant for <br /> diminished earning capacity during the Claimant's remaining life expectancy which is 27 <br /> years according to the life tables published by the Social Security Administration. <br /> Pursuant to Section 18, below, Attorney's Fees of this agreement,the Claimant and Robert Silber <br /> of Staton & Silber, agrees to a 15% contingent fee. After deducting the 15% fee of$45,000.00 <br /> from the Lump Sum, the net amount is $255,000.00. <br /> The Claimant's life expectancy constitutes a period of 324 months or 1404 weeks and the net <br /> lump sum is intended to compensate the Claimant for lost earning capacity at the rate of$787.04 <br /> per month or about $181.62 per week. <br /> 7. Discharge of Payment <br /> The obligation of the Self-Insured Employer to make payments outlined in Section 6-Lump Sum <br /> Payment, will be discharged when a valid check is mailed for the required amount to the last <br /> known address in the Self-Insured Employer's file. If the check is lost or otherwise not received, <br /> the Self-Insured Employer. upon prompt notification of non-receipt, will reissue the check. <br /> subject to verification the check has not been negotiated or otherwise cashed. The Claimant must <br /> promptly notify the Self-Insured Employer of any address change. <br /> 8. Claim Closure <br /> It is the intent of the parties, that at the time this agreement becomes final, Claim SK36496 will <br /> he closed with no permanent impairment beyond what is being paid in the CRSA. Claims <br /> SK36367. SK36352, SJ96226, SH28547, SG15622 and SB12275 are closed and will remain <br /> closed. The Claimant understands other than the payments provided in this agreement the <br /> Claimant will not receive any other benefits, including medical treatment. unless one of the <br /> Claimant's Claims is reopened under Section 10 -Reopening. <br /> Chris Guluarte Page 9 of 14 <br />
