IRC R105.1 Permit required, which reads: <br />Any owner or authorized agent who intends to construct, enlarge, alter, repair, move, <br />demolish or change the occupancy of a building or structure, or to erect, install, enlarge, <br />alter, repair, remove, convert or replace any electrical, gas, mechanical or plumbing <br />system, the installation of which is regulated by this code, or cause any such work to be <br />done, shall first make application to the building official and obtain the required permit. <br />Conclusions of Law Based on Above Findings: <br />1. Construction activity conducted on property within the City of Everett without required City <br />permits is a violation of IRC R105.1. The record demonstrates said City ordinance was <br />violated. <br />2. Unpermitted construction work conducted on the property renders the structure unlawful as <br />defined by IPMC 108.1.4 and is a violation of IPMC 106.1. The record demonstrates said <br />City ordinance was violated. <br />ORDER <br />Based on the findings of fact and conclusions of law stated above, it is hereby determined that <br />the Respondent allowed violation of IPMC 106.1 and IRC R105.1 on the subject property and is <br />hereby ordered to: <br />1. The Respondent must abate all violations of IPMC 106.1 and IRC R105.1 on property <br />located at 6714 Highland Drive, Everett, Washington. <br />2. All abatement of the violations on said property must be completed by April 26, 2018. <br />Abatement shall include: <br />a. The Respondent shall apply for and obtain all of the necessary and required permits to <br />bring the property into compliance with City ordinances. The Respondent shall have a <br />qualified contractor conduct and complete all of the required work and shall have the <br />work inspected and approved by the City of Everett Building Division by April 26, <br />2018. Any violations not listed in this Order are subject to standard enforcement <br />processes and procedures. <br />b. The second dwelling structure is to remain vacant until occupancy has been approved by <br />the City of Everett Building Division. <br />3. The Respondent shall be fined $500.00 for violation of IPMC 106.1 and IRC R105.1. Of <br />the total fine, $400.00 shall be suspended provided the Respondent comply with items 2a-2b <br />of this Order by April 26, 2018. If compliance has not been met by April 26, 2018, the <br />suspended portion of the fine shall be due to the City immediately. <br />4. The Respondent shall pay the $100.00 non -suspended fine no later than November 10, <br />2017. Payment shall be made to the City of Everett Treasurer at 2930 Wetmore Suite 100, <br />Everett Washington, 98201. If payment is not made on or before November 10, 2017 <br />4/9 <br />
