On July 15, 2017, City of Everett Code Enforcement Officer Kevin Fagerstrom conducted <br />an inspection of the subject property and observed and photographed that the basement unit <br />(4212 B) appeared to be vacant. In speaking with the occupants of the upper unit (4212 A), <br />Officer Fagerstrom was informed that the lower unit was vacant. (Exhibit #1 a, Inspection <br />Photo, dated July 15, 2017) ('Testimony of Code Enforcement Officer Fagerstrom) <br />7. On July 27, 2017, the Respondent applied for and was issued permit #CW1707-002 to <br />replace a water heater, a gas range and stove, and to make plumbing repairs to unit (4212 <br />V2). The work received final inspections and approvals on August 1, 2017. (Exhibit #9, <br />TRAKIT Permit Trak Permit 4CW1707-002 Screen Print, dated July 27, 2017) (Testimony <br />of Code Enforcement Officer Fagerstrom) <br />8. On September 11, 2017, Chief Inspector de Budden informed Officer Fagerstrom that <br />violations remained in the residential structure, (4212 A) and (4212 B), that would require <br />City of Everett permits. The Respondent had not applied for or obtained those permits. <br />(Exhibit 410, Email from Ted de Budden, dated September 11, 2017) (Testimony of Code <br />Enforcement Officer Fagerstrom) <br />9. On September 11, 2017, the City issued a violation citation to the Respondent for violations <br />of. International Property Maintenance Code (IPMC) 106.1 Unlawful Acts as adopted by <br />EMC 16.005.010; IPMC 108.1.4 Unlawful Structure as adopted by EMC 16.005.010; and <br />International Residential Code (IRC) R105.1 Permit Required as adopted by EMC <br />16.005.010. Copies of the violation citation were mailed via first class and certified mail to <br />the Respondent's last known address, which Officer Fagerstrom obtained from Snohomish <br />County Assessor's record. A copy of the violation citation was posted on the subject <br />property on September 12, 2017. Each method of service used is independently sufficient to <br />provide notice pursuant to EMC 1.20.010.C.1. Upon research of City permit records, Officer Fagerstrom determined that the Respondent <br />had not applied for or obtained the required City permits to bring unit 4212 A into <br />compliance with City ordinances. At the hearing, City of Everett Building Division Chief Inspector Ted de Budden testified <br />that there were two dwelling units in 4212 A building, an unpermitted basement unit and a <br />main floor unit. He further stated that all issues in building 4212 B have been resolved. The <br />basement unit in building 4212 A had been altered without required City permits into a <br />dwelling unit. Chief Inspector de Budden stated that inspections have not been conducted <br />on building (4212 A) to ensure that all electrical and plumbing systems are compliance with <br />City. The Respondent testified at the hearing that he purchased the property in 2012 at a short sale <br />and was unaware that there was an illegal duplex constructed on it. He presented copies of <br />microfiche, showing that some work conducted on the structure 4212 A had been permitted <br />according to the 1985 and 1986 records.
