FIRE TRAINING PROPERTY USE AGREEMENT AND RELEASE <br /> This Fire Training Property Use Agreement and Release ("Agreement") is <br /> between EVERGREEN RECOVERY CENTERS (AKA EVERGREEN MANOR) <br /> ("Owner") and the CITY OF EVERETT("City") and is dated for reference purposes <br /> March 10, 2022. <br /> RECITALS <br /> The Owner owns the property located at 2604, 2606, 2612, and 2614 Summit <br /> Ave, Everett, WA 98201, which are County Parcel Nos. 00516859502001, <br /> 00516859502200, 00516859502400 and 00516859502600 (collectively, the <br /> "Property"). All of the houses and other structures on the Property (the "Houses") <br /> will be demolished soon by Owner. The City wants to use the Property and the <br /> Houses for fire training purposes. The Owner has agreed to allow this and <br /> understands that the Houses will be damaged by the training. <br /> AGREEMENT <br /> For good and valuable consideration, the receipt and sufficiency of which are <br /> hereby acknowledged, the Owner and City agree as follows: <br /> 1. The Owner grants the City permission to enter and use the Property and <br /> Houses for fire training purposes from March 15, 2022 to March 18, 2022. <br /> The contact persons listed below in Section 4 may extend this time period if <br /> mutually agreed in writing. <br /> 2. The Property and Houses are "AS-IS." The City is responsible for its own <br /> safety and the safety of the training. The City releases the Owner from all <br /> claims for property damage and/or personal injury relating to the City's use <br /> of the Property and the Houses under this Agreement. The City understands <br /> that the Owner is entering into this Agreement and allowing the training in <br /> reliance on this release. <br /> 3. The Owner understands the Houses will be damaged by the City's training <br /> use. This includes without limitation damage to the interior and exterior <br /> walls and fixtures. The Owner releases the City from all claims for personal <br /> injury and/or property damage relating to the City's use of the Property and <br /> the Houses under this Agreement. The Owner understands that the City is <br /> selecting the Property as the training site and entering into this Agreement in <br /> reliance on this release. <br /> 4. This is the entire agreement of the parties on the City's use of the Property <br /> for the time periods described in Section 1 above and supersedes any other <br /> agreement, written or oral. No amendment of this Agreement is effective <br /> unless in writing and signed by both parties, with the Mayor signing for the <br /> City and an Owner-authorized representative signing for the Owner. <br /> 1 <br />
