1.0 INTRODUCTION AND NOTICES
<br /> For this project, HBI is the ground improvement design-build contractor and the ground improvement
<br /> design engineer. In this capacity, HBI performed this evaluation in a manner consistent with the standard
<br /> of care ordinarily exercised by members of the geotechnical engineering community currently practicing in
<br /> the area. SeaLevel Properties is the Owner and the General Contractor ("Contractor") is Graham
<br /> Construction. HBI is contracted with Tiscareno Associates for the design and it is our understanding that
<br /> HBI will be contracted with Graham Construction for the construction of our design. Although there are
<br /> expected to be other consultants and contractors working on this project,none have authority over HBI.
<br /> Any designs prepared and furnished by HBI, including any designs, means, and/or methods(collectively,
<br /> "Designs"),have been prepared based upon, and in anticipation of,HBI performing the work called for in
<br /> such Designs. As such, the Designs are specifically tailored for HBI's purposes and have been prepared
<br /> for exclusive use by HBI. Owner and/or Contractor shall not use or control the Designs without the prior
<br /> written consent of an authorized representative of HBI, and then only as absolutely necessary to perform
<br /> such permitted use.The Designs are subject to protection under the Copyright Act of 1976 and Architectural
<br /> Works Copyright Protection Act of 1990. Owner and/or Contractor shall not copy, reproduce, emulate or
<br /> model the Designs or disclose, publish, or disseminate the Designs to any third parties without the prior
<br /> written approval of an authorized representative of HBI. HBI is and shall continue to be the sole owner of
<br /> the Designs.
<br /> Owner and/or Contractor shall not permit other contractors to use the Designs on this Project or use the
<br /> Designs on other projects without the prior written approval of an authorized representative of HBI. HBI
<br /> makes no warranties or guarantees as to the suitability of the Designs for use by others or for other
<br /> applications or projects.Any such use shall be at Owner and/or Contractor's sole risk,and the Owner and/or
<br /> Contractor shall indemnify, defend, insure, and hold harmless HBI, its agents, consultants, officers,
<br /> directors and employees from and against any and all claims,damages,losses,costs and expenses,including
<br /> but not limited to attorney's fees,costs and expenses,arising out of or resulting from use of the Designs by
<br /> any party other than HBI.
<br /> 2.0 BASIS OF DESIGN
<br /> This design is based on HBI's understanding of the project. Our understanding of the project is based on
<br /> our review of the following documents and performance requirements articulated by the project structural
<br /> engineer and geotechnical engineer.
