change of any nature in the characteristics of the matter being treated. Any and all such devices and equipment shall be subject to the approval of the Commissioner of Public Works, shall not be put into operation without a written permit of approval issued by said Commissioner, shall be provided with all necessary features of con- struction to permit inspection of operations and testing of material passing through them and shall be open to the inspection of the Com- missioner of Public Works at any time. Section 31. SEPARABILITY. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions thereof. Section 32. VIOLATIONS. Any person or persons violating this ordinance or any of the rules and regulations herein provided are hereby declared to be guilty of a misdemeanor, and, upon convic- tion, punishable by a fine of not more than One Hundred Dollars ($100.00) or thirty (30) days in the City Jail, or by both such fine and imprisonment. Section 33 . REPEAL OF INCONSISTENT PROVISIONS. If any section, subsection, clause or sentence of this ordinance shall be held unconstitutional or invalid, such holding shall not affect the validity of the remaining provisions of this ordinance. All ordinances or any sections, paragraphs or parts thereof inconsistent with any of the provisions of this ordinance are hereby repealed.
