-,7'1e ORDINANCE NO AN ORDINANCE providing for the construction of an Interceptor Sewer from the existing outfall on Hayes St. extended Easterly thence Northerly to llth Stj and the construction of lateral combined sewers on the remaining streets, alleys and easements from llth St. north, and by doing all such work necessary to make a complete improvement in accordance with Resolution No. 6119 of the City of. Everett; creating an enlarged district which will be div- ided into a direct benefit district and an indirect benefit district; creat- ing a Local Improvet District; creating a Local Improvement District Fund therefor; providing-the payment of said improvement be made by special assessment on the property in said district under the mode of payment by bonds. WHEREAS, by Resolution No. 6119 of the City of Everett, the City Council has declared its intention to order the improvement as above outlined and by doing all work in connection therewith necessary to make a complete improvement, in accordance with the plans, maps and specifications prepared by the Engineer of the City of Everett, and WHEREAS, the costs of the improvement may exceed the assessed value of the property less improvements and less outstanding unpaid local improve- ment assessments, and WHEEAS, the Health Officer of the City of Everett and the Health Officer of the Snohomish Health District have filed with the legislative authority of the City of Everett a report showing the necessity for such im- provement, and WHEREAS, the City Council by unanimous vote finds that the improve- ment is necessary for the protection of public health and safety, NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: SECTION 1: That the City Council does hereby unanimously find that the improvement herein provided for is necessary for the protection of public health and safety and does hereby unanimously order the same. SECTION 2: That the streets, alleys, xxxxxx, easements and rights- of-way hereinafter named and described be improved by the construction of an Interceptor Sewer from the existing outfall on Hayes St. Extended easterly, thence northerly to llth St; and the construction of lateral combined sewers on the remaining streets, alleys and easements from llth St. north, together with the necessary appurtenances, providing for the necessary surface drainage and doing such other work as may be necessary in connection therewith, all in accordance with maps, plans and specifications on file in the office of the City Engineer, which maps, plans and specifications are hereby adopted: 1. AN EXISTING EASEMENT from the G.N. Railway Company and easements to be acquired along the following described center line: Begin at a manhole to be constructed on G.N. Ry. Co. r/w on the existing 48" sewer on Hayes St. extended 115 ft. m/1, easterly of the east line of Shaffer's First Addition to Everett, Wash.; th northerly along an easement acquired from the G.N. Ry. Co. and an easement to be acquired from Lots 10 & 11, Blk. 323, Shaffer's First Add. to Everett, Lot 15, Blk. 323, Riverdale Add. to Everett, Lots 18, 5C & 5D, Blk. 318, Riverdale Add. to Everett for 1,398.64 ft. to a point on the center line of Winter St. 180 ft. north of the north. property line of 15th St. 2. WINTER STREET from a point 180 ft. north of the north property line of 15th St. to Mill St. • 3. AN FISTING EASEME?T from the G.N. Ry. Co. from Mill St. to llth St. L .
