The imposition of one penalty for a <br /> violation shall not excuse the violation or permit it to continue <br /> and all such persons to whom the Fire Marshal Order has been <br /> issued shall be required to correct or remedy such violation or <br /> defect within the time set forth in such order and/or after such <br /> order has been affirmed or modified or the appeal period has <br /> elapsed for reviewing such order. Each ten days that prohibited <br /> conditions are maintained or a person shall continue to operate <br /> without a permit shall constitute a separate offense . <br /> The application of the above penalty by whatever <br /> action the City of Everett shall take shall not be held to pre- <br /> vent the enforced removal of the prohibited conditions. <br /> Section 12: Validity. <br /> The City of Everett hereby declares that should any <br /> section, paragraph, sentence, or word of this ordinance or of the <br /> code hereby adopted be declared for any reason to be invalid, <br /> it is the intent of the City of Everett that it would have passed <br /> all other portions of this, ordinance independent of the elimina- <br /> tion herefrom of any such portion as may be declared invalid. <br /> Section 13: That Ordinance Nos. 25, 1183, 1275, 1597, <br /> 1631 and 1494 be, and the same are hereby repealed. <br /> Section 14: That Ordinance No. 3414 is hereby super- <br /> seded, except as to all actions and orders heretofore given under <br /> the provisions of said ordinance not yet complied with and <br /> particularly any order of the Fire Marshal involving premises <br /> located at 3114 Oakes Avenue involving George Unsworth and/or <br /> others. <br /> ti <br /> Section 15: This ordinance shall take effect and be in <br /> full force from and after the 10th day of January , 19 59 <br /> i <br /> G MAYOR <br /> Attest: <br /> - 44,..) <br /> GFity ClerwY a <br /> Passed: December 9, 1958 <br /> Published: December 10, 1958 <br />
