<br /> AN ORDINANCE providing for the vacation of the follow-
<br /> ing described portion of street and alley in the City of
<br /> Everett, County of Snohemash, State of Washington, to-wit:
<br /> Spruce Street from Dakota south to the (its)
<br /> intersection with Pacific Ave. and Fulton
<br /> Street in Everett, Snohomish County, Washington.
<br /> WHEREAS, the owners 'of more than two-thirds of the
<br /> private property abutting upon the portion of street and alley
<br /> above described have duly filed their petition with the City
<br /> Council of Everett praying for the vacation of said portion
<br /> of street and alley, and
<br /> WHEREAS, said City Council of the City of Everett did
<br /> by resolution duly adopted, fix the 1st day of October, 1958
<br /> at 101.00 A.M. of said day for the hearing and determination of
<br /> aaid petition, and
<br /> WHEREAS, due and legal notice of the tima and place of
<br /> ,.„
<br /> said hearing and the determination of oaid petition has been .
<br /> a given by the City Clerk in the manner prescribed by law, and
<br /> aatarEAS, at the time and place fixed for hearing
<br /> objections to the vacating of the herein aescribed portion of
<br /> street and alley were heard and discussed, and
<br /> UHEREAS, it now appears to the City Council that said
<br /> petition should be granted subject to certain reservations ana
<br /> exceptions and said City Council does hereby determine to
<br /> vacate the above described portion of said street and alley
<br /> subject to certain reservations and eaceptions,
<br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN:
<br /> Section 1: That the portion of street and alley in
<br /> the Caty of Everett, County of Snohomish, State of Washington,
<br /> described as follows, to-wit:
<br /> Spruce Street from Dakota south to the (its)
<br /> intersection with Pacific Ave. and Fulton
<br /> Street in Everett, Snohomish County, Washington
<br /> be, and the sane is hereby vacated subject to the following
<br /> conditions and reservation: the City of Everett retains an easeaant
<br /> to eonstruct, maintain and operate sewer lines and other utilitie,
<br /> under, over and across said property otherwise vacated, and pro-
<br /> vided further that the grantee estee herein, shall not
<br /> construct any building or structure over and across such vacated
<br /> street exeeot pursuant to written permit of the 4taaefPerett.
