. ? , , A <br /> ft . , <br /> ORDINANCE NO. 747 <br /> AN ORDINANCE amending Section )4 of Ordinance No. 3536 en- <br /> titled: <br /> An Ordinance providing vacation pay for certain <br /> city employees of the City of Everett and super- <br /> seding Ordinance No. 3275 and declaring an <br /> emergency to exist. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1 : That Section 4 of Ordinance No. 3536 be, and <br /> it is hereby amended to read as follows : <br /> Section 4: Each employee who shall have worked <br /> twelve consecutive months during the preceding year, <br /> and all day laborers who shall be qualified to re- <br /> ceive vacation pay as provided in Section 6, whose <br /> service is terminated either voluntarily, involuntarily <br /> or by death shall be allowed pay for any vacation <br /> earned in the preceding year and in the current year <br /> not taken prior to separation from city service, pro- <br /> vided that an employee voluntarily resigning shall <br /> have given ten days notice prior to his resignation <br /> or retirement. Payment for a vacation may be made to <br /> an employee who, during any year, was not granted the <br /> vacation to which such employee was entitled, solely <br /> on account of the inability of the City to obtain a <br /> suitable relief employee; provided, further, that <br /> before payment can be made for a vacation not actually <br /> taken the City Council shall determine that such pay- <br /> ment is necessary to prevent an injustice to the em- <br /> ployee involved and shall, by resolution or ordinance, <br /> authorize such payment within thirty (30) days of the <br /> expiration of the year for which any such payment is <br /> made. No such payment shall be made to an employee <br /> who fails to request a vacation or fails to take his <br /> or her vacation at the time allotted by the department <br /> head.
