Ilk <br /> . . <br /> I. <br /> ORDINANCE NO. 3658 <br /> AN ORDINANCE providing for the acquisition by con- <br /> demnation of land necessary and convenient for the proper <br /> construction, control, maintenance and operation of one or more <br /> water supply lines for the furnishing of a supply of fresh water <br /> into the City of Everett, together with the construction and <br /> maintenance of a telephone line or lines for the use of the City <br /> in connection with its municipal water system and municipal <br /> communication system and directing the City Attorney to institute <br /> condemnation proceedings for the purpose of acquiring said land <br /> and declaring an emergency to exist. <br /> WHEREAS, the City of Everett is in the process of <br /> building a fresh water supply line from Lake Chaplain to the City <br /> of Everett for the purpose of supplying the City of Everett with <br /> fresh water from its storage basin at Lake Chaplain, and it is <br /> anticipated that additional lines will be built over said land, <br /> and <br /> WHEREAS, it has been determined that it is necessary <br /> and convenient that the City of Everett take the fee simple title <br /> to the land hereinafter described for the purpose of constructing, <br /> operating, replacing, repairing and maintaining a water supply <br /> line system and communications system under, over and across the <br /> property hereinafter described, <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1 : That public necessity demands and requires <br /> that the fee simple title to the land hereinafter described be <br /> condemned, taken and appropriated for public use and the same is <br /> hereby condemned, taken and appropriated for a public object and <br /> public use and necessity as follows : For the purpose of con- <br /> structing, operating, maintaining, replacing and repairing one or <br /> more water supply lines for the purpose of furnishing into the <br /> City of Everett a supply of fresh water, together with the <br /> construction and maintenance of a telephone line or lines for the <br /> use of the City in connection with its municipal water system <br /> and municipal communications system. <br /> Section 2: That the City of Everett condemn, acquire <br /> appropriate and take the fee simple title to the following <br /> described land now in the ownership of and owned by Harold S. <br /> Ofstie : <br /> That part of Government Lot 1, Section 28, Township <br /> 29 North, Range 5 East, W.M. , lying North and West <br /> of former Northern Pacific Railroad right-of-way, <br /> EXCEPT East 200 feet thereof; <br /> EXCEPT 50 foot strip along entire south shore of <br /> Snohomish River in Government Lot 1 as conveyed to <br /> Pacific Tow Boat Company by deed recorded under <br /> Auditor' s File No. 1026259, records of Snohomish <br /> County; <br /> EXCEPT State Highway No. 15; <br /> EXCEPT right-of-way of Chicago-Milwaukee, St. Paul & <br /> Pacific Railroad; and <br /> EXCEPT right-of-way of Diking District No. 1 of <br /> Snohomish County, Washington. <br />
