. w <br /> ORDINANCE NO. 3649 <br /> AN ORDINANCE amending Sections 25, 49, 94, 116, 118, 119 <br /> and 160 of Ordinance No. 3211 entitled: <br /> An Ordinance relating to and regulating traffic, travel, <br /> transportation and pedestrians and their incidents upon <br /> the streets, alleys and public ways of Everett, a <br /> municipal corporation; prescribing the rules of road for <br /> vehicular, pedestrian and other traffic upon such streets, <br /> alleys and public ways; prescribing the powers and duties <br /> of the officers and other persons in relation thereto; <br /> defining offenses; providing penalties; adopting certain <br /> portions of the motor vehicle laws of the State of Wash- <br /> ington and existing amendments thereto; and repealing <br /> Ordinance numbers 2318, 2734, 150, 2348, 2522 and 2612, <br /> all relating to traffic. <br /> and declaring an emergency. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1 : That Section 25 of Ordinance No. 3211 be, and <br /> the same is hereby amended to read as follows : <br /> Section 25 : DISREGARD OF BARRIERS, WARNING SIGNALS <br /> AND FLAGMEN. No person shall disregard warning signals <br /> or barriers lawfully placed in a street by the City of <br /> Everett, Snohomish County or the State of Washington, <br /> nor the warning signal of a flagman stationed near <br /> railroad crossings or other inherently danagerous places, <br /> or where workmen are employed upon the street. <br /> Section 2: That Section 1-I-9 of Ordinance No. 3211 be, and <br /> the same is hereby amended to read as follows : <br /> Section 49 : LOAD MUST BE PREVENTED FROM LEAKING OR <br /> DROPPING ON PUBLIC HIGHWAY. No vehicles shall be driven <br /> or moved or allowed to stand on any public highway unless <br /> such vehicle is so constructed or loaded as to prevent <br /> any of its load from dropping, shifting, leaking or other- <br /> wise escaping therefrom, except that sand may be dropped <br /> for the purpose of securing traction, or water or other <br /> substance may be sprinkled on a roadway in the cleaning <br /> or maintaining of such roadway by a public authority <br /> having jurisdiction. Any person operating a vehicle from <br /> which any glass or objects have fallen or escaped, which <br /> would constitute an obstruction or injure a vehicle or <br /> otherwise endanger travel upon such public highway shall <br /> immediately cause the public highway to be cleaned of all <br /> such glass or objects. It shall be unlawful for any <br /> person to throw or drop any glass object, debris or any <br /> waste from any moving vehicle or upon the right of way of <br /> any public highway. <br /> Section 3: That Section 94 of Ordinance No. 3211 be, and <br /> the same is hereby amended to read as follows : <br /> Section 94: RIGHT OF WAY WHEN TURNING AT INTER- <br /> SECTION. It shall be the duty of any operator of any <br /> vehicle upon entering an intersection and having <br /> signalled his intention as required by law to turn such <br /> vehicle to the left to look out for and give right of way <br /> to vehicles approaching in the opposite direction and <br /> thereby placed on his right, simultaneously approaching <br /> the given point within the intersection, whether such <br /> vehicle first enters and reaches the intersection or not. <br />
