ORDINANCE NO. 3627 VOL 62j PACE-257 AN ORDINANCE providing for the vacation of the following describ portion of street and alley in the City of Everett, County Snohomish, State of Washington, to-wit: The, alley west of Lell Avenue from 34th Street to a pot 195 ft. south of '34th Street, being the alley in BlpOk 2 of Rucker Park i4dition to the City of Everett, from 34th Street to the south boundary line of Lot 11. WIMREAS, the owners of more than two-thirds of the private property abutting upon the portion of street and alley above described have duly filed their petition with the City Council of Everett praying for the vacation of said portion of street and alley, and WHEREAS, zaid City Council of the City of Everett did by resolution duly adopted, fix the 20th day of June, 1957 at 10:00 o 'clock a.m. of said day for the hearing and determination of said peteteon, and =inn clue and leeal not.' cc en the ter and place of said hearing ane tee2 determination of said petition has been given by the city clerk in the manner prescribed by law, and WHEREAS, at the time and place fixed for hearing objections to the vacating of the herein described portion of street and alley were heard and discnssed, and WHEREAS, it now appears to the City Council that said petition should be granted subject to certain reservations and exceptions and said City Council does hereby determine to vacate the above described portion of said street and alley subject to certain reservations and excentions, NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That the portion of street and alley in the City of Everett, County of Snohomish, State of 'dashington, described as follows, to-wit: The alley west of Bell Avenue from 34th Street to a point 295 ft. south of 34th Street, being the alley fin Block 2 of Rucker Park Addition to the City of Everett, from 34th Street to the soutn boundary line of Lot 11. be, allel the same is hereby vacated and the title to the land in said portion of street and alley above described is hereby declar- ed to vest in the abutting property owners as provided by law, except the City of Everett retains an easement under, over and acrose said property vacated for the construction, repair and maintenance of public utilities and services, together with the right to construct sewer lines, water lines and other utility lines under, over and across said property, and provided further that no building or structures shall be erected under, over or across said land to be vacated without first having secured a permit from the City Entelneer of the City of Everett to erect said building or structure. Provided further, that if any utilities are constructed ander provision of local improvement district laws of the State of Washington the abutting property owners shall be assessed forthe cost of the improvement In accordance with the laws of the State of Washington and the ordinances of the City of Everett.
