ORDINANCE NO. 3587 AN ORDINANCE granting to the Great Northern Railway Company, its successors or assigns, the right, privilege and authority to locate, lay down, construct, maintain and operate for a period of twenty-five (25) years from and after this ordinance be- comes effective, a railroad spur track over and across Paine Avenue from the westerly boundary thereof in Block 797, Everett Land Company' s First Addition to Everett, and easterly across 798, and thence over and across Smith Avenue to the easterly boundary thereof, to a connection with the track of the Great Northern Railway Company. THE CITY COUNCIL OF THE CITY OF EVERETT DO ORDAIN AS FOLLOWS: Section 1: That there is hereby granted to the Great Northern Railway Company, its successors or assigns, for a period of twenty- five (25) years from and after the date this ordinance becomes effective, a right of way for and the right, privilege and authority to lay down, construct, maintain and operate a spur track over and across Paine Avenue, commencing at the westerly boundary thereof in Block 797 of the Plat of Everett Land Company's First Addition to Everett, extending across Block 798 over and across Smith Avenue to the easterly boundary thereof, to a connection with track of the Great Northern Railway Company. It is acknowledged that the spur track herein described was constructed pursuant to Ordinances No. 1009 (Paine Avenue) and No. 611 (Smith Avenue) , which have heretofore expired, and that the tracks described herein are still in existence and are being maintained and operated by the Great Northern Railway Company, which desires to continue to maintain and operate said spur track. Section 2: That wherever the said track crosses or is crossed by a street or avenue now constructed or to be hereafter constructed, laid out or extended, said Grantee, its successors and assigns, shall plank and/or keep in repair all that portion of the improved street or avenue occupied by its tracks to the end of the ties on each side. Should the City of Everett pave or otherwise improve said street or avenue, the Grantee agrees that all portions of the street or avenue occupied by its track to the end of the ties on each side of said track shall be paved or improved by the Grantee.
