ORDINANCE NO. 3S7c AN ORDINANCE providing for the improvement of: CEDAR STREET from 19th St. to 18th St. on the west side only by the construction of concrete curbs and gutters, concrete sidewalks where necessary; and Cedar St. on the east side only from 19th St. north to the end of the existing sidewalk by the construction of concrete curbs and gutters, concrete sidewalks and including as a part of said work the construction or reconstruction, where necessary, of all sewers, side sewers, water mains and hydrants with necessary appurtenances, by such grading or regrading as may be necessary, installation of necessary drainage and by doing such other work as may be necessary in connection therewith, all in accordance with a majority petition therefor; creating a local improvement district; creating a local improvement fund and providing for payment of said improvement by special assessment on the property in said district under the mode of payment by bonds . WHEREAS, there has been heretofore filed with the City Council of the City of Everett a majority petition of the pro- perty owners petitioning for said improvement, and upon examina- tion thereof the said City Council has found the things set forth therein to be true, and WHEREAS, the said petition has been referred to the Commissioner of Public Works to be examined by said Commissioner and the City Engineer, and the Commissioner of Public Works has filed with the City Council all data and information required by law, NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1 : That the following improvement be made : CEDAR STREET from 19th St. to 18th St. on the west side only by the construction of ooncrete curbs and gutters, concrete sidewalks where necessary; and Cedar St. on the east side only from 19th St. north to the end of the existing sidewalk by the construction of concrete curbs and gutters, concrete sidewalks and including as a part of said work the construction or reconstruction, where necessary, of all sewers, side sewers, water mains and hydrants with necessary appurtenances, by such grading or regrading as may be necessary, installation of necessary drainage and by doing such other work as may be necessary in connection therewith all according to the plans and specifications prepared under the direction of the City Engineer and which plans and specifications are hereby approved and adopted. Section 2: That the costs and expense of such improve- ment, including all necessary incidental expenses, shall be borne by and assessed against the property included in the assessment district herein created in accordance with the law. The City of Everett shall not be liable in any manner for any portion of the costs and expenses of such improvement, except as provided by Chapter 141, Session Laws of 1923, or acts amendatory thereto, and the ordinances of the City of Everett.
