Amend- <br /> ments nay be initiated in the o11o,,'ing manner: <br /> (1) By motion of the Council or Planning Commission. <br /> (2) By the filing with the Planning Commission of a petition of owner of <br /> property within the City, which petition shall be on a standard form pro- <br /> scribed by the Planning Commission, and shall be accompanied by a receipt <br /> for a fee of ka5.O0, payable to the City Treasurer and deposited to the <br /> credit of the City. No part of the fee shall be returnable <br /> The Planning Commission shall hold a public hearing on any such petition, no- <br /> tice of which hearing and of the proposed amendment shall be given by publication <br /> in the official newspaper of the City at least seven days before the date of such <br /> hearing. <br /> L. petition for a change in a zone classification or zone boundary lines shall <br /> carry the signatures of not loss than fifty-one per cent of the owners of any proper- <br /> ty within 200 feet of the property lines of the petitioner, Either spouse nay <br /> sign as owner. Signing the petition shall not indicate endorsement by the surround- <br /> ing property owners. <br /> In recommending the adoption of any proposed amendment or in concurring with <br /> the Counc'1 on any proposed amendment, the Planning Commission shall fully state <br /> its reasons at tho public hearing before the Council, describing any change in con- <br /> ditions that it believes makes the amendment advisable and specifically setting forth <br /> the manner in which the Planning Commission is of the opinion that the amendment is . <br /> 1 in harmony with a comprehensive plan of land use for the town. <br /> Before adopting any amendment, the Council. shall adopt a resolution setting <br /> forth the findings upon which 4t determines such ane:<dnent to be required by the <br /> public interest in the furtherance o: the purposes set forth in Section 2 of this <br /> Ordinance. <br /> SECTION 22. VIOLATIONS LND PENALTIES <br /> Any person, firm or corporation who violates, disobeys, omits, neglects or <br /> refuses to comply with, or who resists the enforce-lent of any of the provisions of <br /> this Ordinance, shall be doomed guilty of a nisdeaneanor, and upon conviction there- <br /> of shall be fined not more than $100.00 or imprisoned for a term not exceeding 30 <br /> days, or both, for each separate offense. Each day that a violation is permitted <br /> to exist shall constitute a separate offense. <br /> SECTION 23. VALIDITY <br /> If any section, subsection, paragraph, sentence, clause or phrase of this Ordi- <br /> nance is declared by any court of competent jurisdiction to be invalid, such invali- <br /> dity shall not affect any other portion of this Ordinance. <br /> SECTION 24. REPEALING CLAUSE <br /> Ordinance #2954 and all Ordinances in conflict herewith are hereby euporcedod. <br /> SECTION 24 EFFECTIVE DATE <br /> This ordinance shall take effect and be in force on December 1, 1956. <br /> -31- <br />
