ORDINANCE NO. 3565 AN ORDINANCE providing for the improvement of: ROCKEFELLER AVE. from the Athletic Field to a point approximately 433.74 ft. north of the Athletic Field (in the SW of the NW , Sec. 17, T 29 N, R 5 EWMM) by the construction of a sewer, together with the necessary appurtenances, providing for the necessary sewer drainage and doing such other work as may be necessary in connection therewith, all in accordance with a majority petition therefor, creating a local improvement district, creating a local improvement fund, and providing for payment of said improvement by special assess- ment on the property in said district under the mode of payment by bonds. WHEREAS, there has been heretofore filed with the City Council of the City of Everett a majority petition of the pro- perty owners petitioning for said improvement, and upon examina- tion thereof the said City Council has found the things set forth therein to be true, and WHEREAS, the said petition has been referred to the Commissioner of Public Works to be examined by said Commissioner and the City Engineer, and the Commissioner of Public Works has filed with the City Council all data and information required by law, NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That ROCKEFELLER AVE. from the Athletic Field to a point approximately 433.74 ft. north of the Athletic Field ( in the SW* of the NW* Sec. 17, T 29 N, R 5 EWM) be improved by the construction of a sewer, together with the necessary appurtenances, providing for the necessary sewer drain- age and doing such other work as may be necessary in connection therewith, all according to the plans and specifications prepared under the direction of the City Engineer and which plans and specifications are hereby approved and adopted. Section 2: That the cost and expense of such improve- ment, including all necessary incidental expenses, shall be borne by and assessed against the property included in the assessment district herein created in accordance with the special benefits conferred without regard to the zone and termini method of spread- ing assessments. The City of Everett shall not be liable in any manner for any portion of the costs and expenses of such improve- ment, except as provided by Chapter 141, Session Laws of 1923, or acts amendatory thereto, and the ordinances of the City of Everett. Section 3: That there is hereby established a local improvement district to be known as "Local Improvement District No. 643 ", which district shall include the following described property located in Everett, Snohomish County, Washington: Commencing at the SW corner of Lot 14, Blk. 219 of Bailey Add.'; th westerly along the south line of Bailey Add. for 10 ft„ m/1, to an intersection with the line lying 10 ft. west of and parallel to the east property line of Rockefeller Avenue as platted in Bailey Addition produced; th south along said line lying 10 ft. west of and pll. to the east property line of Rockefeller Ave.
