•RDINANCE NO. <br /> AN ORDINANCE providing for the improvement of: <br /> BROADWAY AVENUE from the center line of 10th Street <br /> to a point 420 ft. south of the center line of 10th <br /> Street on both sides of the street <br /> by the construction of portland cement concrete curbs and 18" <br /> gutters, installation or reinstallation of all necessary drain- <br /> age, the construction or reconstruction of all sewers, side <br /> sewers, water mains and hydrants with necessary appurtenances, <br /> the construction or reconstruction of concrete sidewalks where <br /> necessary, by such grading or regrading as may be necessary and <br /> doing such other work as may be necessary in connection there- <br /> with, all in accordance with a majority petition therefor; <br /> creating a local improvement district; creating a local improve- <br /> ment fund, and providing for payment of said improvement by <br /> special assessment on the property in said district under the <br /> mode of payment by bonds. <br /> WHEREAS, there has been heretofore filed with the City <br /> Council of the City of Everett a majority petition of the pro- <br /> perty owners petitioning for said improvement, and upon examina- <br /> tion thereof the said City Council has found the things set <br /> forth therein to be true, and <br /> WHEREAS, the said petition has been referred to the <br /> Commissioner of Public Works to be examined by said Commissioner <br /> and the City Engineer, and the Commissioner of Public Works has <br /> filed with the City Council all data and information required by <br /> law, <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1 : That <br /> BROADWAY AVENUE from the center line of 10th Street <br /> to a point 420 ft. south of the center line of 10th <br /> Street on both sides of the street be improved <br /> by the construction of portland cement concrete curbs and 18" <br /> gutters, installation or reinstallation of all necessary drain- <br /> age, the construction or reconstruction of all sewers, side <br /> sewers, water mains and hydrants with necessary appurtenances, <br /> the construction or reconstruction of concrete sidewalks where <br /> necessary, by such grading or regrading as may be necessary and <br /> doing such other work as may be necessary in connection therewith, <br /> all according to the plans and specifications prepared under the <br /> direction of the City Engineer and which plans and specifications <br /> are hereby approved and adopted. <br /> Section 2: That the costs and expenses of such improve- <br /> ment, including all necessary incidental expenses, shall be <br /> borne by and assessed against the property included in the assess- <br /> ment district herein created in accordancevith the special <br /> benefits conferred without regard to the zone and termini method <br /> of spreading assessments as provided by Rem. Rev. Stat. 9365- <br /> 1947 Supplement. The City of Everett shall not be liable in any <br /> manner for any portion of the costs and expenses of such im- <br /> provement, except as provided by Chapter 141, Session Laws of <br /> 1923, or acts amendatory thereto, and the ordinances of the City <br /> of Everett. <br />
