•RDINANCE NO. AN ORDINANCE providing for the improvement of: BROADWAY AVENUE from the center line of 10th Street to a point 420 ft. south of the center line of 10th Street on both sides of the street by the construction of portland cement concrete curbs and 18" gutters, installation or reinstallation of all necessary drain- age, the construction or reconstruction of all sewers, side sewers, water mains and hydrants with necessary appurtenances, the construction or reconstruction of concrete sidewalks where necessary, by such grading or regrading as may be necessary and doing such other work as may be necessary in connection there- with, all in accordance with a majority petition therefor; creating a local improvement district; creating a local improve- ment fund, and providing for payment of said improvement by special assessment on the property in said district under the mode of payment by bonds. WHEREAS, there has been heretofore filed with the City Council of the City of Everett a majority petition of the pro- perty owners petitioning for said improvement, and upon examina- tion thereof the said City Council has found the things set forth therein to be true, and WHEREAS, the said petition has been referred to the Commissioner of Public Works to be examined by said Commissioner and the City Engineer, and the Commissioner of Public Works has filed with the City Council all data and information required by law, NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1 : That BROADWAY AVENUE from the center line of 10th Street to a point 420 ft. south of the center line of 10th Street on both sides of the street be improved by the construction of portland cement concrete curbs and 18" gutters, installation or reinstallation of all necessary drain- age, the construction or reconstruction of all sewers, side sewers, water mains and hydrants with necessary appurtenances, the construction or reconstruction of concrete sidewalks where necessary, by such grading or regrading as may be necessary and doing such other work as may be necessary in connection therewith, all according to the plans and specifications prepared under the direction of the City Engineer and which plans and specifications are hereby approved and adopted. Section 2: That the costs and expenses of such improve- ment, including all necessary incidental expenses, shall be borne by and assessed against the property included in the assess- ment district herein created in accordancevith the special benefits conferred without regard to the zone and termini method of spreading assessments as provided by Rem. Rev. Stat. 9365- 1947 Supplement. The City of Everett shall not be liable in any manner for any portion of the costs and expenses of such im- provement, except as provided by Chapter 141, Session Laws of 1923, or acts amendatory thereto, and the ordinances of the City of Everett.
