ORDINANCE NO. 3555 AN ORDINANCE providing for the improvement of: 48th STREET from Delaware Ave. to Wilmington Ave by the construction of a concrete sidewalk and concrete curbs and gutters on the south side of the street only and WILMINGTON AVENUE from 48th St. to 50th St. by the construction of a concrete sidewalk and concrete curb and gutters on the east side of the street only; by such grading and regrading as may be necessary, by the installation of necessary drainage or the removal and replacement of existing drainage and doing such other work as may be necessary in connection therewith, all in accordance with a majority petition therefor, creating a local improvement district, creating a local improvement fund, and providing for payment of said improvement by special assessment on the property in said district under the mode of payment by bonds. WHEREAS, there has been heretofore filed with the City Council of the City of Everett a majority petition of the property owners petitioning for said improvement, and upon examination thereof the said City Council has found the things set forth therein to be true, and WHEREAS, the said petition has been referred to the Commissioner of Public Works to be examined by said Commissioner and the City Engineer, and the Commissioner of Public Works has filed with the City Council all data and information required by law, NOW THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1 : That 48th STREET from Delaware Ave. to Wilmington Ave. be improved by the construction of a concrete sidewalk and concrete curbs and gutters on the south side of the street only, and WILMINGTON AVENUE from 48th St. to 50th St. be improved by the construction of a concrete sidewalk and con- crete curb and gutters on the east side of the street only; by such grading or regrading as may be necessary, the installation of necessary drainage or the removal and replacement of existing drainage and doing such other work as may be necessary in connec- tion therewith, all according to the plans and specifications prepared under the direction of the City Engineer and which plans and specifications are hereby approved and adopted. Section 2: That the cost and expense of such improvement including all necessary incidental expenses, shall be borne by and assessed against the property included in the assessment district herein created in accordance with the special benefits conferred without regard to the zone and termini method of spreading assessments. The City of Everett shall not be liable in any manner for any portion of the costs and expenses of such improvement, except as provided by Chapter 141, Session Laws of 1923, or acts amendatory thereto, and the ordinances of the City of Everett. -1-
